College Students Rights And Guarantee Of Rights

A series of laws and decrees on education have been promulgated one after another in recent ten years. These laws and decrees provide legal guarantee in the following respects: promotion of development of our education; maintenance of the management principles of education; protection of citizen's educational rights and in the adjustment of various social relationships during the process of education, etc. Legislation on education is also being speeded up, which guarantees the process of popularization of education. However, little attention has been paid to the students, and the consciousness of the students rights is not so strong, and infringing upon students rights becomes common occurrences in the process of running a new school and the students' education.By study of the history of the students rights consciousness, this paper points out the history inertia of the students rights consciousness; expounds the hardships in striving for students rights; tries to make an analysis of the students rights from the point of view of jurisprudence as well as indicates that studying human rights is not enough, it is the students identity that should be focused on when studying students rights. As a matter of fact ,human rights , viewed as "weak law" to a certain degree , can be carried out only with the permission of the nation's law and decree and a powerful law enforcement organization. International laws concerning human rights are just supplementary laws. More efforts should be made to turn "should-have" rights into put-into-effect rights. By analyzing the educational phenomenon of students rights and the studying of rights in the process of education and the rights in school, eight rights of college students together with their legal basis have been put forward , which are the main chapters of this paper.Analysis of the rights consciousness of both school and students lays foundation for the guarantee of rights. Only with the cooperation of the school, government, society, family and students on the respects of conception, system, legislation and execution can the students rights be guaranteed effectively.
