On Preservative Bankruptcy Law System And Bankruptcy Law System In China And Japan

In market economy, there is a law that some enterprises and person shoud be washed out. So the bankruptcy law is necessary and some other laws, such as laws respecting prevent insolvent, conformity enterprise, activation, concerting the bankruptcy law, are also important. All the laws are called in Japan Restoration law.The bankruptcy law of China is not perfect. It is out of data and is not adapt market economy such as its application is narrow, it is not to apply individual, it has a lot of scotomas. All this shortcomings tell us the bankruptcy law system shoud be amended.When the author learn and study Japan bankruptcy law system, I found it has many elites. This is the Japan bankruptcy law is a part of its restoration law system. The restoration law system consist with the regeneracy of company, the coordinate of company, the peace negotiations specialties liquidate and bankruptcy. According to Japan restoration law system, I think we shoud set China restoration law system.Of couse, we have China company law system and there is the reform of company, annex of company, conformity of company. This shows we have the practise foundation to set China restoration law system.With the compare law method, this article introduces the Japan restoration law system and gives the author's opinion to amend China bankruptcy law.
