The Research On The Regime Of International Seabed Mining

Twenty years passed, since 'Parallel system' was governed by 1982 UN Convention on the law of the sea. Practice and development for these twenty years have helped decide the steadfast goal for the deep seabed mining in the future just doing in accordance with economic rules breaking up rigid mining regime, for the purposes of peace, promoting every cooperation of mankind as a whole in the international seabed.'Commercial system' has been decided in accordance with the spirit of international cooperation. The Agreement on Carrying out Part XI of 1982 UN convention on the law of the sea is the mark of 'commercial system'.The Regulations on Prospecting and Exploration for Polymetallic Nodules in the Area is the first regulation of the Authority, which governs states prospecting and exploration in the Area. It is only applicable to the exploitation for Polymetallic Nodules. As to exploitation for other mines, the Authority will make new regulations, rules and procedures, in order that every exploitation for resources in the Area will develop soundly, and the Area can realize its value as 'common heritage' of mankind actually.It is estimated that international seabed commercial mining will start at 2015, while there will be a lot of questions to face and among them the questions relating to investment and transfer of technology should be taken into consideration at first. This article introduces the 'Parallel system' of the UN convention, the 'commercial system' of the Agreement and the Regulations of Authority based on the 'commercial system', at the same time the questions relating to investment and transfer of technology are researched respectively. In order that the Regime of international seabedmining are known by more people and hope that it can cause a debate in academic area, break up the silence on the regime of international seabed mining.
