Researches On The Principle Of Efficiency In Criminal Procedure Before Trial

China's criminal procedure system become more and more democracy and scientific on the new conditions. The procedure before trial plays a very important role in the criminal procedure in many countries. Meanwhile the principle of efficiency undoubtedly is one of the most important questions. This article analyses the expression of the principle of efficiency in many countries on the base of explaining the principle of efficiency,then the author points out that there are many shortcomings in China's criminal procedure and puts forward some proposals.This article is divided into three contents.The basic tenet of the principle of efficiency is divided into three parties. The first party which is the concept of principle of efficiency explain that this article will apply the concept in two ways:the philosophical and the economical,and then emphatically points out that the principle of efficiency consists the economical reason of the criminal procedure and the economical reason of the procedure results. The second party which is the relations between the efficiency and the justice emphatically analyses the relations between the efficiency and the justice in the procedure before trial,and then points out that the author believe we must insist in the efficiency has priority comparing with the justice. The third party which is the means of the principle of efficiency in the procedure before trial analyses the excellent means of the principle of efficiency from two parties:suppressing the crime and protecting the human rights.The second content the expression of the principle of efficiency in other countries analyses the expression of the principle of efficiency in the United States,the Britain,the Japan,the France and the German which is the relatively loosen judicial power,the thrift of procedure cost and the reason supplement of justice resources. Among them,the relatively loosen justice power mainly contains relatively loosen supervision to the judicial offices and giving more free judgement power to judicial organ. The thrift of procedure cost mainly contains shortening the procedure period and simplifying or merging or canceling the procedure.. The reason supplement of justice resources contains applying the principle of ratio and dealing with each case on it merits.The third content the improvement of China's criminal procedure before trial is divided into two parties. The first party which is the expression of the principle of efficiency in China analyses the expression of the principle of efficiency in our country,and then points out that there are so many shortcomings . In the second party which is the improvement of China's criminal procedure before trial,the author advances some proposals from three respects:reforming the ideas,reconstituting the judicial offices and reforming the procedure models.
