Abstract/Summary:
Because of the long history of two thousand years of feudalism, China used to be a country stamped more with the brand of feudal autocracy than the tradition of democracy and legality. However, the Chinese people have been looking forward for their coming and struggling hard for the realization. Specially mentioned here is the Communist Party members with Mr. Deng Xiaoping as the leader lead the Chinese people to work hard to construct the socialist system.During the Anti-Japanese War, Deng Xiaoping set out to rectify the army and strengthen the revolutionary base areas with disciplines and laws and took great effect, which is regarded as his early legal thoughts. After the establishment of New China, the socialist legal construction was paid more attention to; some important laws were drafted and executed. But in the late 50s, the appearance of nihilism and anarchism in law resulted in the occurrence of the" Great Cultural Revolution ", which caused an inestimable damage to our Party and people. Mr. Deng Xiaoping realized that the only way to avoid the reoccurrence of such tragedies as the "Great Cultural Revolution" was to strictly enforce the democracy and make great effort to carry out the laws. He, successively, put forward a series of important legal ideas, especially his two speech at the closing session of the working conference of the Central Committee of the Communist Party of China held on Dec. 13, 1978, relating his legal thought systematically, which marks the formation of his thoughts of law.The 15th People Congress of the Party poses the great goal: to administer the country by law and to build the socialist country by law ". This is a result of the summery and thinking about the history, also, guided by Mr. Deng XiaoPing's legal thought. It has solved many major problem required to be done in the socialist legal country therefore it has great vitality for it is based on the people, facts, time, science, innovation and entirety, which is of great theoretical and practical value both to the construction of our socialist legal system and maintenance of a lasting good order of our counting.This essay consists of four parts. The first part analyses and studies the formation, and base of Deng XiaoPing's legal thought. The second generalizes its main content. The third analyzes the features and the fourth briefly summaries its great value.
