Educational fairness is the reflect of social fairness value in educational field . And it is also the extension of equality rights in political and economic fields in educational field . Educational fairness refers to the fairness towards every educational object in educational activities and the judgement towards every educational object. It is both an idealism, controlled by "Proportion Equality" principle , on the fairness of educational object ih educational activity and legal rules to ensure the realization of the idealism . Educational fairness is a dynamic and developing concept . And it comprises not only the equality of educational starting point but also the equality of educational process and judgement . Our country had a late start on the theory research of it and the present laws and rules are unable to suit the demands of it . So we consider that rule by law in education is the legal guarantee of realization of educational fairness . And it is the way to educational fairness to correctly handle with the relationship between equity and competition , equity and profits , teachers and students and to persist in the equality in basic rights field and the un-equality in non-basic rights fields.
