Research On Legal Protection Of The Non-Material Cultural Heritage Of Ethnic Minorities In China

China is a country with the history of five-thousand-years civilization. In the long-term historical development, the minority has created a brilliant non-material cultural heritage. Chinese non-material cultural heritage of ethnic minorities reflect the unique spirit values of national, ways of thinking and cultural awareness, and so it has a special charm and value. The protection of non-material cultural heritage of ethnic minorities has respect to national cultural-safety, social harmonious-development and the heritage of national culture. However, due to natural reasons, the lack of lag and intensity level of legislative protection results in the fracture of lineage of the non-material cultural heritage of ethnic minorities, or even making it disappear, so that the non-material cultural heritage of ethnic minorities have been seriously damaged and destroyed. Currently, it is very urgent to rescue and protect the non-material cultural heritage of ethnic minorities.For the effective protection of the existing non-material cultural heritage of ethnic minorities, as the title of this article, the author especially analysis and research the non-material cultural heritage of ethnic minorities, and put forward legislative proposals related to protection. This article consists of four parts: the definition of the non-material cultural heritage of ethnic minorities; the relevant legislation visit of international conventions and foreign protection of the non-material cultural heritage; the status perspective of the non-material cultural heritage of ethnic minorities in China and the legislative protect- ion of our non-material cultural heritage of ethnic minorities.First of all, the first part defines the non-material cultural heritage of ethnic minorities, and then from the constitutional perspective, it has the special significance for our country to research the legal protection of the non-material cultural heritage of ethnic minorities.Through the presentation of the course of development of international law and international conventions on the non-material cultural heritage, the second part retrospects its history and combs its context changing. It can provide experience for our legislation on the non-material cultural heritage of ethnic minorities to analysis the foreign protection of it.Firstly, the third part expounds the history and actions of China's accession to the Convention. And then through discussing the status of legislation and analyzing problems, it provides the basis in reality for proposing legislative measures.On account of the existing problems, Part IV ponders over the legal protection of the non-material cultural heritage of ethnic minorities, and put forward the legislative countermeasure.In order to curb the loss of cultural resources, keep the world's cultural diversity and make our rich non-material cultural heritage of ethnic minorities reproducing brilliant, from the existing international and domestic relevant provisions of its protection, this article researches the international legislation and Chinese status perspective of protecting it. Drawing on the advanced experience of other countries, the author put forward countermeasures in the legislative protection of our non-material cultural heritage of ethnic minorities.
