Influence On The "Great Leap Forward" From Constitution Construction In The Early Stage Of State Establishment

The first constitution which was formally enacted and executed in 1954 stipulates National People's Congress is the supreme organ of state power and important decision is made in accordance with democratic centralism. But "the Great Leap Forward" occurred after three years when constitution was enacted and executed. As for decision procedure "the Great Leap Forward" is not reviewed by National People's Congress and not decided in the principle of democratic centralism. Why is the constitution disesteemed in such short time so that CPC congress substitutes for law and individual willpower is superior to the collective willpower to cause gross fault?The dissertation shows that Chinese constitution construction steps into a brand new phase after state establishment. 1954's constitution has great limitation in legislation gilding ideology and adjusted object, so there is no adjusted object for the constitution after completion of socialist transformation. On the other hand CPC decision is dependent on the faith for Mao Zedong for a long term. Therefore it is inevitable that "the Great Leap Forward" occurs when Mao Zedong persists in left-leaning Mistakes.The dissertation includes five sections. The first section is foreword that states academic and realistic significance. The second section describes significance and action of constitution. Constitution as state fundamental law has supreme legal force and behavior is consistent with basic essence and items of constitution. The third section mainly analyzes Chinese legal system, limitation of 1954's Constitution and constitution concept of Mao Zedong after 1954's Constitution is enacted. 1954's Constitution is limited so that the there is no adjusted object for the constitution after socialistic reform for private ownership of the means of production and absence of constitution causes that decision system specified by system of National People's Congress and democratic centralism is released from binding force. The fourth section analyzes the relation between limitation of constitution construction and decision on "the Great Leap Forward". In the absence of constitution the Communist Party of China makes decision on "the Great Leap Forward" and individual status of Mao Zedong is reinforced. Individual willpower substitutes for collective willpower and is promoted to national willpower so that "the Great Leap Forward" is successfully developed. Finally the dissertation shows that state is administered in accordance with law to construct socialistic political civilization and avoid historical tragedy recapitulation.
