On Legal Issues Of Rural Source Of Drinking Water Protection

Source of drinking water is the fundamental resources of human survival and development. Rural source of drinking water is extremely different from urban source of drinking water. Rural source of drinking water is being threatened severely, whose way of protecting has many problems. With raising of"New Socialist Countryside"stragtic task, it is necessary to choose to protect rural source of drinking water in a legal way, which can safeguard the safety of drinking water, and promote to solve the problem of rural people's livelihood.This dissertation consists of six parts. Chapter one is"The preface"which concisely indicates the background of the topic, the meaning of the topic, the present situation of study at home and abroad, the goal of study.Chapter two is"Outline of Protection of rural source of drinking water". This part firstly introduced the present situation of rural source of drinking water in our country. Secondly, the author elaborated the teoretical basis of protection of rural source of drinking water separately from the angle of"theory of human rights"and"theory of the rural construction". This part thirdly pointed out four major issues on protection of rral source of drinking water in our country.Chapter three is"The present legal situation and issue of protection of rural source of drinking water". Firstly This part introduced the detailed legal system and institution of protection of rural source of drinking water. Secondly, I analyzed the legal root about rural source of drinking water above. I pointed out the defects of current legal system; maladjustment to protection of rural source of drinking water of current legal institution; blankness of legal institution on protection of rural source of drinking water; current rural environmental management system's restricting the protection of rural source of drinking water.Chapter four is"the reference of the legislation on source of drinking water protection abroad". This part introduces rules of foreign domestic law on protection of source of drinking water, and gives a comparative analysis of the legislation and characteristic ,which provide experiences for legislation of rural source of drinking water protection in China.Chapter five is"perfecting the conceiving of the legislation of rural source of drinking water protection in China"is the emphasis of the dissertation. The writer basing on the theory previous, and aiming at the deficiency of the protection of rural source of drinking water in our country, suggests to improve legal system of protection of rural source of drinking water and to amend the current legal system and institution and to remedy the spacing of legislation with the guiding ideology of"the scientific concept of development", and with the principle of priority, prevention, safety, and state support.Chapter six is"epilogue"concisely summarize the returns and lacks of the study.
