A Preliminary Study On The Obstacles Of Water Right Transfer And Their Countermeasures

Water resources are important natural resources relate to human existence and development. It has unique exterior characteristics, including: externality of the technology, externality of the inter-generational, externality of the storage, and externality of the environment. Water market allocation is the best ways of three models of water resources allocation .They are water resources administration allocation, water user participation or negotiation allocation , and the water market allocation. In our country, the shortage and the waste of water resources exist at the same time. Thereby, system innovation and new water right transfer system establishing are necessary. Presently, the definition of the water right is in ambiguity and the water right transfer market is unfounded, there are still many obstacles to water right transfer. This dissertation stress the definition of the "water right" , adopt the idea of rectifying the water right externality and reducing the trade cost of water right transfer, expatiate the leading obstacles of our country's water right transfer from law, technical and system respects, all these expatiation are founded on analyzing the "DongYang-YiWu" case. Furthermore, this essay suggests constructing organization system, trade system and operation procedure of our country's water right transfer market, and gives advices on how to supervise and control the water right transfer market effectively.
