Study On Legal Issues Of Preventing Rural Domestic Pollution In China

With The new village construction is promoting fierily in our country,the environment in some countryside is being improved and a picture of new village is presented preliminary. But, because of attached so much importance to industrial pollution and awfully neglected the pollution of rural environment, it is so difficult for rural environment and economy to develop now. The domestic pollution is taking a big part in the rural pollution. Take a research on it is an appropriate way to educate the public, and has a tremendous significance to build the harmonious new countryside and rule of law new countryside construction.The thesis have four parts, the first part is the preface which explains the background and value, the researches at home and abroad,the research technique and purpose of the thesis.The second part of the thesis introduces the basic dependent concept of the rural domestic pollution, investigates the different characteristics of domestic pollution between rural and urban, and analyzes the hazardless and its subjective and objective reasons. Then, indicates the significance and essentiality to perfect the legal system of the rural domestic pollution.The third part is to analyze the deficiencies of the law on rural domestic pollution. Points out that the current legislation is far from completed which reflects in these fields. First, the guiding ideology is obsolete. Second, the legislation is not paying much attention on rural areas. Third, the statute is so formalist that it is hard to carry out。In addition to these, weak law enforcement is another main problem which reflects in the following things. Firstly, the masses of the people have no consciousness to protecting the environment of rural, and the government isn't aware enough of administrating the rural domestic pollution. Then, the rural domestic pollution preventing administration system is incomplete, the obligation is equivocal. Besides, there is no condition for public participation.The fourth part is to present the legal advice of preventing the rural domestic pollution, basing on the analysis and summary in above-mentioned theory. Specifically, this part is divided into four parts. The first part is the ultimate of preventing the rural domestic pollution. That is to insist on ecological legal interest, public participation, Urban-Rural integration coordinated development, scientific determination of waste treatment and, recycling in the work of preventing rural domestic pollution. The second part is to establish and hold the essential legal system of preventing rural domestic pollution. Which comprise defining the responsibility of pollution; establishing the ecological rules and regulations to deal with the pollution; building the financial incentive institution. The third part is to regulate the law enforcement, to perfect the mechanism of administer of preventing rural pollution and to improve the supervisory system. The fourth part is saying to advocate public participation so as that more people can take part in the work of preventing the rural domestic pollution.
