Study On Agricultural Production And Environmental Protection Laws From The Perspective Of New Rural Construction

The Sixteenth Plenary Session of the Fifth CPC Central Committee adopted " the CPC Central Committee's Eleventh Five-Year Plan recommendations of National Economy and Social Development" in 2005,which proposed the general objective of building a new socialist countryside " enhanced productive forces, higher living standards, civilized living style, an orderly and clean environment and democratic administration ".But with the development of economy, environmental problems arising in the agricultural production have impeded the realization of the goal of new rural construction and hampered the harmonious development between economy, society and environment. The present author believes that to solve these environmental problems, agricultural production must proceed according to Agricultural Law. Meanwhile, we should strengthen the construction of laws and policies concerning agricultural production and environmental protection. Only with the protection from legal policy, it is possible to take a sustainable path which can both develop urban and rural agriculture and promote the integration of urban and rural environmental protection.In this article, the present author adopt the environmental sociology methods in my field research in Sanmenxia of Henan Province and analyze environmental issues and its causes appearing in its new rural construction, which reflects the environmental conditions of agricultural production. Then I introduce in detail the status of environmental protection laws and policies, the implementation effect and the achievements and shortcomings of environmental protection laws and policies about agricultural production. I also make a future comparison between environmental protection laws and policies in China combining and those in EU and Japan. Finally, aspects of law, law economics, sociology, ecology science, the present author put forward legal policy proposals, which are applicable in China's agricultural development and beneficial to the building of resource conserving and environment-friendly agriculture production system, and the realization of the goal of new rural construction.
