| In recent years, the participation of the public to the enviroment protecction has become the mainly tendency of the international enviroment protection. But in our country, this participation is in a low level. This situation is related to the disamplifieation of the public participate system in our enviroment law.The participation of the public to the enviroment protecction the source theenvironmental protection tide and which grows to ever greater heights and the people's knewledge to the environment question deep levelthat in the 20th century 60's.It is unceasingly develops in the practice summarizes.It also is the humansurvival environment unceasingly worsens the result which andenvironmental protection consciousness unceasingly strengthens. Theoverseas scholar proposed one after another "the environment publicproperty" discusses, "the environment public request" discusses with"the citizen environment power" the theory which provide the theory basis to the public participation in the enviromental law. Along with "Human environment Manifesto" and "In ApproximatelyEnvironment And Development Manifesto" and so on the global legaldocument appears one after another, the environmental public participated proposed the program. In the world many countries, specially some developed countries made the substantive law and the procedural law to protect the citizens'stipulation.This article studied the foreign developed countries'the participation of the public to the enviroment protecction, and introduced theirs related legislation achievement.At the same time, the paper concentrated on the situation and problems of the public participation in our country and on the ground of the introduction of foreign experience . Finally the paper will make some suggestions to these problems.Only after the amplification of the regulations of public participation, will the purpose of environment legislation been realized, as well as the continuously developing trategy. |
