With the rapid development of the new era of technological innovation,artificial intelligence technology is being integrated into all aspects of life development.The integration and development of artificial intelligence in the field of judicial decision reasoning have also become a significant direction of China’s judicial system reform.In July 2018,Jianzhu Meng,secretary of the Central Committee of Political and Legal Affairs,attended the national judicial system reform promotion meeting and stressed the need to “embrace the new era of big data and artificial intelligence more proactively,combine conceptual thinking enhancement,institutional mechanism innovation,modern technology application,and legal system improvement,and fully implement the new system of judicial responsibility and related supporting reforms”.This marks the transition from the application of information management systems in the industrial era and information era to the in-depth application of artificial intelligence in the intelligent era in China’s judicial field.The development of an artificial intelligence application mode of judicial adjudication will play a key role in the current stage of“more cases and fewer people” and “uneven judicial resources”,which will become a significant direction of China’s judicial system reform.From the theoretical aspect,this paper proposed innovative research on the game strategy selection and adaptability evaluation of the AI application model of judicial adjudication based on the perspective of management decision-making,which was aimed at making up for the research perspective of the academic community other than the field of law and computer technology;from the practical aspect,the development of the AI application model of judicial adjudication in China at this stage is in the stage of rapid development,and there are both opportunities and challenges.In light of this development opportunity,it is crucial to conduct comprehensive,systematic,and scientific research on the application of artificial intelligence in judicial adjudication.In view of this,this paper explored the game strategy selection and adaptability evaluation of the AI application model for judicial adjudication,which is a research problem with theoretical and practical significance.To study the problem of the artificial intelligence application model for judicial adjudication,clarify the research purpose and research content,further sort out the relevant literature and theoretical foundation,and propose research questions with feasibility and necessity,the following aspects of work have been done:(1)Explored the development pattern of the AI application model of judicial adjudication at the present stage as well as the development status.Firstly,sorted out the connotation and shortcomings of the traditional judicial adjudication model and the connotation and advantages of the artificial intelligence application model of judicial adjudication and further explored the advantages and significance of the artificial intelligence application model of judicial adjudication through comparative analysis.Secondly,by defining the concept and classifying the application model of AI in judicial adjudication,two models of AI application model in judicial adjudication were proposed: the auxiliary participation model and the substantive participation model.This was followed by a case study of a typical application model for supporting analysis.Finally,the operation mechanism of the two AI application models of judicial adjudication was elaborated in two dimensions: system architecture and influencing factors,with a view to exploring the theoretical basis for the development of judicial AI application models in future development.(2)In order to solve “the problem of choosing strategies for two different AI application models of judicial adjudication”,explored the impact of dynamic influencing factors on the game strategies of AI application models of judicial adjudication.The game problem between courts and litigants under the new development pattern of AI application mode of judicial adjudication was analyzed.A dynamic game evolution model was constructed for the court to adopt different application modes and the litigant to choose whether to implement the behavioral strategy,taking into account the dynamic effects of different application modes’ benefit factors,cost factors,risk factors,and even premium factors,and the game model between the court and the litigant was comprehensively analyzed to seek dynamic equilibrium and stable strategies.The system simulation SD model was combined to construct the game system dynamics flow chart of the court and the litigant.The range of values of the relevant key factors was controlled and adjusted one by one for numerical simulation analysis.In order to verify the influence trend of different range of benefit factors,cost factors,risk factors,and even premium factors of different application models,the influence mechanism of key influence factors on courts and litigants was scientifically and intuitively presented,providing some useful reference for the subsequent development of corresponding application models.(3)In order to solve the problem of “the degree of development of AI application model for judicial adjudication at the current stage”,an applicability evaluation study was carried out.On the basis of the previous qualitative analysis,the interval Pythagorean fuzzy multi-attribute decision method was combined with the improved score function and prospect theory.Considering the novelty of the evaluation problem,data in the form of interval Pythagorean fuzzy numbers were collected,which could better ensure the scientific and reasonable construction of the model.In addition,the applicability evaluation index system of the artificial intelligence application model of judicial adjudication was innovatively proposed to provide some theoretical supplements to the applicability evaluation research.Further analysis was carried out on the shortcomings of the development of the current AI application model for judicial adjudication through evaluation data so as to seek new gaps in the research questions and provide research ideas and theoretical contributions for subsequent studies.(4)In order to respond to “the shortcomings of the traditional judicial adjudication model-the problem of difficult supervision of judges’ value judgment”,the theory of reliability analysis of judicial value judgment in the artificial intelligence application model of judicial adjudication was innovatively propose.One of the shortcomings of the traditional judicial adjudication model is that the subjective value judgment of judges might lead to different judgments in the same case.In addition,the current artificial intelligence application model of judicial adjudication doesn’t realize the wisdom function of value judgment.Based on this research gap,this paper innovatively proposed the reliability evaluation index system of judicial value judgment from the perspective of management decision.The purpose was to evaluate the reliability of value judgment through this model for tried cases and use the results to assist judges in carrying out the reliability analysis of value judgment.By combining DS evidence reasoning theory,this paper constructed a scientific and systematic reliability analysis model of judicial value judgment.This paper verified the rationality and feasibility of the reliability analysis of the model with real case law,with a view to making some basic theoretical supplements and useful references for the realization of value judgment reasoning in the future transformation of the wisdom judicial paradigm.Finally,based on the aforementioned research work,this paper summarized the main research results and conclusions,distilled the main research contributions,reflected on the limitations of the existing research,and proposed ideas for possible future research directions.
