Research On The Clean Government System In Taiwan China

The clean government system in China’s Taiwan includes the ideology,norms,agencies,procedure,and practice of clean government.On the basis of concrete analysis of these contents,we can deepen our understanding of the clean government system in Taiwan,discover the problems existing in the current operation of the clean government system in Taiwan and the trends in future development,thus to provide guidance for the construction of an clean government system in the mainland.The study is divided into eight parts,the contents of each part are as follows:The origin,research significance,research status and research methods of the study are briefly described in the introduction part.The first chapter is the ideological origin of the clean government system in Taiwan.In ancient China,such contents as “constructing the government with integrity”,“govern the country through the governance of officials”,and “promoting justice with morals” are the traditions of Chinese clean governance culture,meanwhile the cultural foundation of the clean government system in Taiwan.The theory of popular sovereignty,restriction of powers,and governance theory in western rule of law has demonstrated the requirements for a clean government at different levels,which has become the legal basis of the clean government system in Taiwan.Dr.Sun Yat-sen’s “constitution of five powers”,“division of power and function”,“independence of supervision”,“surveillance of censor” were not only the initial logic of the establishment of a clean government system in Taiwan,but also the basic concept of the clean government system in Taiwan.The above contents together constitute the ideological origin of clean government in Taiwan.The second chapter is the legal source of the clean government system in Taiwan.From the perspective of statutory law,this chapter collates Taiwan region’s source of clean governance before the Kuomintang “Relocation to Taiwan”,as well as during and after “The Martial Period” until present.This information is sorted out and analyzed from the levels of “constitutional law”,“general law”,“regulations and orders” and “administrative rules”.The third chapter is about the organizational structure in the clean government system in Taiwan.In China’s Taiwan,the “Anti-Corruption Administration”,“Political Style Institution”,“Investigation Bureau”,“Prosecution Office” and the“Supervisory Institution” under the supervision system have formed a model of coordinating and promoting the construction of a clean government.This chapter is divided into five sections to sort out and analyze the function of clean government and the performance of clean government in the development of these clean government agencies.The fourth chapter is about relevant procedures in the operation of the clean government system in Taiwan.This chapter discusses procedural issues from the investigation procedures of Taiwan’s corruption cases,the cohesion mechanism of the clean government agencies in the work,and the relief procedures in the operation of the clean government system.The investigation of anti-corruption cases is mainly discussed under the two systems of administration and supervision.The cohesion mechanism focuses on explaining the conflict and coordination mechanism between the “Anti-Corruption Administration” and the “Investigation Bureau”,and the “Integration Prosecutor” system created by the “Anti-Corruption Administration” together with the “Prosecution Office”.The relief procedure focuses on three types of relief,including administrative relief,independent agency relief and judicial relief.The fifth chapter is the practice of clean government in Taiwan.This chapter divides the practice of clean governance in Taiwan from the perspective of historical development into four periods before the Kuomingtang “Relocation to Taiwan”,during “The Martial Period”,after “The Martial Period” to 2011,and from 2011 till now.The situation of clean government in Taiwan shows different characteristics during these four different stages of development.The sixth chapter is about the realistic predicament and development trend of clean governance in Taiwan.This chapter analyzes the predicament of the current clean government system in Taiwan from the perspectives of system and practice.Based on the previous analysis of the practice of clean governance in Taiwan,this part analyses the trends of the development of the clean government system in Taiwan,including the legalization of clean government construction,refining of clean government norms,the professionalization of clean government agencies,and the increasing participation of the public and social supervision.The conclusion part is based on a brief comparison of cross-strait clean government systems.It proposes that while drawing lessons from the clean government system in Taiwan,the mainland should also guard against the problems that have arisen in the operation of the clean government system in Taiwan.
