International Comparative Study On Resource-based Multinational Government Regulation

Mineral resources are an important material basis for human survival and development,an important guarantee of national security.Ensuring the supply of mineral resources’security has always been an important political and foreign policy of countries to safeguard national security.In the world war of competing for control of mineral resources,the resource-based multinational companies play a pivotal role.On the one hand,resource-based multinational companies which has virtue of its strong economic strength,advanced production technology and a mature sales network,promotes the rational development and utilization of mineral resources in the worldwide;On the other hand,which is more important,the nature of resource-based multinational companies have determines that they must try to reap excessive profits by a monopoly,and thus defeat the host country’s national industry,even control of the host country’s economic lifeline.It is no exaggeration to say that the resource-based multinational companies become the host country’s national security threat.Thus,a major issue before us:how the rational use of multinational financial and technical resources to ensure the safety of the host mineral resources,and thus to guarantee the national security of the host country?Strengthen the government regulation of the resource-based multinational companies is our choice.Scholars used a variety of methods from different perspectives,carried out deep study on the relationship among the government regulation,multinational companies and host governments,and achieved fruitful results.However,the results are lack of specific studies on the resource-based multinational companies as well as resource-based multinational government regulation issues.At the same time,due to different situations,China cannot copy the practical experience of Western countries,resource-based multinational government control.Therefore,comparing the practice of Chinese resource-based multinational companies government control with the Western countries’ situation,then combination of the advanced experience of Western countries and Chinese national conditions,and then put forward the program during the deepening market economic reform period,which is about the resource-based multinational corporations of Government Control,that is particularly important.Separated the top three of the United States,Russia,Chinese reserves of mineral resources,the United States has the world’s most developed market economy and the most advanced system of government control,Russia and China have a similar course of development,now are on the key period of economic transformation,the United States and Russia,selected as the comparison object of great practical significance.Core interests of the resource-based multinational in the host country are the host government,employees,and the natural environment.The relationship between the resource-based multinational companies and the host country is:resource-based multinationals in the host country’s specific legal framework,social norms and business environment at the same time to fulfill their basic economic functions contact well with the host country,the contact formation with the host country,directly or indirectly,and have an impact on both sides in the political,economic,and cultural aspects.The typical market failures caused by the resource-based multinationals in the host country,including:raised by the monopoly threat to the host country’s economic security,avoidance caused by asymmetric information and infringement of the interests of employees’ behavior,pollution caused by the externalities of environmental behavior.The contribution embodied in practice of this paper:Firstly,on the six aspects of current situation and basic policy of the mineral resources,the evolution of government regulation policy,governmental control legislation,administrative control and admittance control among resource-based multinational corporations are compared,and summarized the common features and general laws of countries in the resource-based multinational government regulation practice,and deep analyzed the differences and the reasons of countries to reflect the practice of resource-based multinational government control;Secondly,this thesis has made analysis among China’s resource-based multinational corporation of its governmental control reform on political science basis,economic basis and practical basis;Thirdly,this thesis has raised the goal of China’s resource-based multinational corporation of its governmental control reform:to realize effective control;Forth,this thesis has established the basic concept of China’s resource-based multinational corporation of its governmental control reform:transform from omnipotent government to effective government,transform from administrative control based government to service control based government,and set up the market mechanism and the government control mutually blended regulatory mechanism;Finally,this thesis has built policy system of China’s resource-based multinational corporation of its governmental regulation reform:improve the government regulation legal system,,set up highly efficient and independent government regulatory agency,strengthen admittance regulation,improve transfer pricing control,strengthen labor rights protection control.
