Public And Private:Harmonic Governance In The Process Of Property Right Differentiation

State governance is established on a certain economic basis,and the economic bases has different characteristics in practice,of which the public property rights and private property rights are the most typical forms of expression.According to Marx,Engels and other classical writers,property rights initially presented as a form of public property rights,along with the development of private property rights,the contradiction between public property rights and private property rights intensified,which eventually lead private property rights "blow up" public property rights,at the same time,the interest differentiation and social conflicts brought by private property rights are difficult to reconcile,thus need state governance to solve the problem effectively.Through a survey of a clan village,this article found that the clan has both public property rights and private property rights,but property rights private does not "blow up" the public property rights,instead they maintained a long-term coexistence state.At the same time,under the condition of very limited state governance ability,the clan realized the balanced development of "public" and "private,through its own governance.Based on the empirical research method,this paper examines the relationship between the property rights form and the governance form of a clan village,so as to explore the operating logic of the property rights of the clan society,and how the clan can reconcile the contradictions and conflicts caused by the division of property rights through internal governance.Therefore,this article discusses from two aspects:on the one hand,analysis the property forms of the clan,particularly discusses the internal structure and function of clan public property rights and private property rights,as well as the tension and conflict caused by the differentiation of property rights.On the other hand,from the perspective of clan governance,discusses how clan through internal governance to reconcile the conflict between the public and private.Through analysis and research,this paper has the following findings:first,in the process from the clan society to modern society,the growth of "private" is not simple to blow up the "public",the development from public owned to private owned is not a split,but a long process of replacement.For the traditional clan society,public property rights and private property rights are not binary opposite,the private ownership of property bring the family and clan the development power and vitality,and public property system arrangements can make up for the defects of traditional state governance to a large extent,playing a substitute and complement function of state governance.Second,effective governance of clan is an important means to reconcile the "public and private contradictions".There is inherent tension between public property rights and private property rights,the development of private property rights will bring the interests differentiation and conflict,and clan through internal governance to achieve "public repress private",so that "private" can be maintained in a certain limit,which can promote the stable development of the clan community.Again,the arrangement of the property rights system is based on certain conditions.The property rights arrangement of traditional clan society reflects the social background dominated by blood relationship.When the historical conditions change,the property right system needs to adjust and change accordingly.Finally,from the perspective of social development,the growth of private property rights is the trend,with the development of the times,the family public owned and clan public owned will weakened more and more,but still need some rural "public" factors to reconcile the contradictions of private owned,thus to make up for the lack of public supply problems,but the modern "public" should go beyond the traditional clan "blood public" to establish a modem society "regional public".The effective construction of "regional public" and national public governance need to identify the fit system"contact".The choice of this "contact" may be varied in reality and requires local scientific grasp and selection according to its own conditions.
