| In China,it is unrealistic to discuss national conditions without the Communist Party.Inner-party governance affects every corner of governance.The number of party members of the Communist Party of China has exceeded 90 million,of which about 80% of the national civil servants and more than 95% of leading cadres are party members.Doing a good job in China depends largely on the governance of Communist Party.Entering a new era,China’s social fabric and national structure are transforming.Profound changes have taken place in economic structure,political layout,benefit distribution pattern and ideology field.At the same time,governance issues such as corruption and ideological confusion have been magnified by the new media,and been examined by the information society.The problems of governance within the party weaken the party’s governing effectiveness,and at the same time radiate the progress of governance of the entire country through spillover effects.The urgency of intra-party governance is unprecedented,but the theoretical framework of intra-party governance and the characteristic discourse system of socialist country governance are still in a growing period,and it is difficult to resist the modern western rule of law and party theory.This article takes the rule-based governance by the Communist Party of China as the starting point and intends to answer five questions: What is the definition of rulebased governance? What is the basis for implementing the rule-based governance? What is the experience of rule-based governance according to regulations? What are the problems? What are the countermeasures? In this way,while consolidating the existing institutional advantages within the party,the institutional advantages will be more efficiently converted into the effectiveness of governance,enriching the connotation of the modernization of state governance in the new era.First,what is the definition of rule-based governance by the Communist Party of China? The concept of rule-based governance by the Communist Party of China is defined as: governing the party by regulations is the further deepening of the rule of law thinking in the field of party construction.The Communist Party of China builds a scientific and complete system of laws and regulations within the party,and uses the laws and regulations of the party to govern party affairs,party member behavior,and party political life.The essence of rule-based governance by the Communist Party of China is to clarify the division of powers and responsibilities,and regulate the operation of power.The goal of rule-based governance by the Communist Party of China is to use the legal attributes to govern the party,to keep the party vital while leading the construction of the rule of law in China,and to promote the modernization of the national governance system and governance capabilities.Second,what is the basis for implementing the rule-based governance by the Communist Party of China? This article explains the theoretical basis according to regulations from three aspects: political party theory,ruling party theory,and the rule of law theory.Exploring the realistic basis for rule-based governance by the Communist Party of China from three perspectives: world situation,domestic situation,and historical experience.From the gradually evolving theoretical framework of governing the rule by law,law-based governance,and rule-based governance explains the regulations basis.At the same time,what are the experiences and problems of rule-based governance by the Communist Party of China? This article summarizes the landmark achievements and experiences of the new democratic revolution period,the initial period of socialism exploration,the new period,and the new era.Based on this,the main problems in the new era are summarized: First,the concept of rule-based governance by the Communist Party of China itself is not clear,abstract,and concise.Second,the focus of rule-based governance by the Communist Party of China needs to be shifted from thinking to implementation.The third is that the content and implementation procedures of internal party regulations are fragmented,irregular,and lacking in comprehensiveness.Fourth,the rule of law and rule-based governance were implemented at the same time.The rule of law thinking has not yet been fully recognized by the mainstream ideology of the society.And governing the party according to regulations lacks fault tolerance and correction measures.Fifth,there is the impact of lack of belief and historical nihilism in governing the party’s soft environment according to regulations.Finally,what are the countermeasures for further advancing the rule-based governance by the Communist Party of China? This article starts from two aspects: the mechanism for generating laws and regulations and the execution effectiveness of governing.While consolidating the advantages of the system,it converts the advantages of the system into governance effectiveness.Mechanism for generating laws and regulations: First,clarifying the principles for the construction of laws and regulations(adherence to scientific theory,people’s standpoint,and the spirit of the rule of law).Second,proposing an entry point for optimizing the mechanism for generating laws and regulations in the new era(configuration of regulations,exchange training,and democratic participation).The third is to clarify the future focus of the regulation generation mechanism(complementing the compliance review mechanism to form a closed-loop internal party regulation generation mechanism).The effectiveness of governing: First,through "round table learning" and a new model of selecting and employing system,strict administration of officials was achieved.The second is to standardize the operation internal party power with supervision as the guarantee.The third is to promote the integration of rule-based governance and rule by law,from the perspective of legislative and process cohesion.The fourth is to make up for the bottom-up measures and enrich the relief measures for rule-based governance by the Communist Party of China. |
