Law is the standard of rules.Besides the essential criterion,law also has many quality criteria.The measure of education is and should be one part of the rules.Citizens' obeying to rules,humans' practice,law's study,academic development and assessment of the rules of law all need the construction of the measure of education.However,this measure is hidden or absent in fact.The study about education measure of law is trying to make this theory perfect and to improve the practice.This paper is based upon the plasticity of human and the necessity of regulation in human's education.Adopting philosophy,law and pedagogy theory,especially the theory of measure,following the steps of designing,defining,perorating,constructing,and concluding,this paper demonstrates and discusses the education measure of law from the perspective of structure and generalization.The designing part paves this paper.This part has been mentioned in the preface and its main task is to state the research topic.It demonstrates related articles about measure and the education measure,law and the study of education in law.This part also designs the goals,content,approaches,structures and innovation points.It adopts philosophical thinking,concept analysis,historical analysis,sociological analysis,scale analysis and pedagogical analysis of law.This part demonstrates that the research task is the exploring of the dimension,quality and quantity of the education of law and then try to form theory about the education measure and offering some pedagogical advice about managing state affairs in accordance with the law fully.The defining part is the base of this paper.This part discusses what is law and the education measure.In the first chapter “what is law?-describing the world of rule”,it explains periodic reconstruction,derived revolution,systematic structure and so on.Itapplies natural law,regulation law,living law and Internet law and describes the world of rule from the source of its power,main contradiction,supporting evidence,the state of its existence and its essence.“The first chapter Scale Reconstruction of the Law's Concept”,the periodic reconstruction,the derivative change and the systematic reengineering of the law were illustrated.It explains periodic reconstruction,derived revolution,systematic structure and so on.It applies natural law,regulation law,living law and Internet law and describes the world of rule from the source of its power,main contradiction,supporting evidence,the state of its existence and its essence.“The second chapter The Education Measure-the Measure of Education in Ontology”,it discusses the concept pedigree of the measure,the definition and relation,category,purpose and value of the education measure.In the basis of criticizing pre-existing theories,this part demonstrates that “the education measure is the regularity of quantity and quality of education”,its core value is that by education we humans can promote and realize life development and blessing living and the relation and difference with the measure of development and pedagogy.This chapter classifies the measures based upon this.From the scale,it can be divided into large,medium,and small.From the directing category,it can be divided into existence,practice and cognition.From the abstract degree,it can be divided into principle,regulation and index.From the structural morphology,it can be divided into total factor,synoptic factor and single factor.From the value orientation,it can be divided into individualism,universalism and so on.“The third chapter the Legal Value of the Education Measure”analyzes theory and practice basis of the rule's existence and necessity of strengthening the criterion of education from the aspect of its necessity,the reason of its absence and the result of it.As the attribute of education is the quality of law,law includes the education varieties and education has consequent inner relations with law,the education measure is the essential scale of law.Because of political game,the interruption of the traditions of legal system,the faults in constructing legal system,low position of education subjects and the absence of rule research,the education measure practice and education cognition is absent from rule.Constructing the education measure for law is not only the necessary choice of social development,the urgent need of human oriented requirement and the realistic requirement of network governance,but also the logical extension of rule evolution and fundamental trend of legal civilization.“The measure construction” is the main body of this paper.It has been discussed in “The second chapter-To perfect the measure system of law”.This part chiefly explains the existence,practice and cognition of education measure and these criteria's position and relations in the measure of law,aimed at answering the question of how“the measure of education” is.“The first chapter The existence about the measure of law-exploring the law principle of education existence”,it demonstrates five criteria of the existence about education of law.”Law's reliance of education to realize the compatibility of social cognition” is its fundamental criterion.Besides it is also necessary to respect cognitive base,acquire the dominant right of education,form education-dominated thought and realize that action and education can promote legal civilization.“Law's close relationship with education” is its structural criterion.Law and education are co-existing in right and duty.The right to education is inalienable.Organization and system share the same structure.Sticking to rule-governed organization,legal regulation and the interaction with system are beneficial to realize the function of education.In order to form synergic relationship between the psychology and actions of human beings,human society needs to achieve the unity of emotions,reason and rule,unity of knowledge and action,unity of instructions and regulations,and unity of psychological counseling and material limit.”Social law's requirement to transit into reasonable influence on education” is its operational criterion.The law requirement's transition to lawful text of educational essence and lawful text's transition to human action are two important educational transitions.While using educational transition technology,principles of humans' normalization-orientated,problem-targeted,information-consistent,recycled,designed and redesigned are needed to stick to.“Different educational specialty of different fields of law” is its ecological measure.The educational specialty of the regulation about the right of public law,the self-government of private law and the community reasoning of social law are needed to strengthen.“Social members sharing legal system” is its developmental measure.Mutual understanding needs to insist on the principles of education measure of law-optimizing educational behavior in rule practice,it demonstrates five criteria about practice of education.“Principles of education's reliance in normative text” is its essential criterion.In order to turn law normative text into nice educational text,it is necessary to enhance education base,improve the regulations of education and highlight education function.“Education organization rooted in legal system” is its structural measure.For achieving this,it is necessary to promote the functionalization of education special agency,the normalization of education cooperative agency and the specialization of mixing education agency.“Education action rooted in the function of law” is its functional measure.To achieve this,it is needed to increase the power about the citizens' right and citizens' awareness,to construct the dialogue system,to build data platform and service system and promote multi-agent dialogues and dialogue education.“Education index existing in the assessment of law” is its introspective measure.The index should include such as the matching degree of laws and regulations,the educational concomitant of rule practice,the pubic validity of rule education,the success rate of education preventing and reforming criminals and the education acceleration of social justice.“Education thinking melting in lawful revolution” is polyphyly of the quality.Rule in fact possesses the measure of the existence of education.The measure of the practice of education needs to strengthen the construction of the realistic scale.The measure of the cognition ofeducation should focus on educating people,making people understand,promoting humans' regular development and realizing social justice and order.As to “The essential measure of law + the cognition of education measure”,this combination is the logical starting point of law-crossed theory and subjects.The theory of educational measure of law has great significance in guiding to all the citizens abides by the law,and the appendix lists 36 educational suggestions on the specific policy of the comprehensive framework for promoting the rule of law.The research about the education measure of law is the research about the fundamental problems in rule pedagogy.In order to deepen this research,we can strive to pay our attention on specific law and departmental law,the mixing and blending of the measure of constructing pedagogy and exploratory method and others in theory and practice.
