On The Modern Historical Development Of Prosecution System In Hunan Province And Its Practice

The procuratorial system is an important part of the judicial system,which is of great significance in ensuring justice and fairness and justice.It is not the product of China’s inherent cultural soil and local institutional environment,but the result of modern learning and transplanting western legal system.Therefore,with the survival of the legal cultural and spiritual values,our country in the process of accepting the Western procuratorial system is not Everything is going smoothly.but full of frustrations and setbacks,and the successful experience,more failures.This article reviews the development of modern Hunan procuratorial system as the research object,the use of historical sociology,literature,sociology and other theories and methods,to explore the historical evolution process of Hunan procuratorial system,summarize the procuratorial authority operation,case handling practice operation,analysis of Hunan experience and the development of procuratorial system and on this basis,to provide historical reference for our current procuratorial system reform,promote the local law.The first chapter is the introduction,which mainly introduces the significance of the topic,the scope and the object of the research,the research status and the research ideas and methods.The second chapter introduces the origin of China’s procuratorial system.China’s procuratorial system originated in the late Qing Dynasty constitutional and law,is the end of the Qing Dynasty to learn the western judicial system and transplant results.If China’s procuratorial system is the mainstream,then the procuratorial system of Hunan is a tributary,Hunan in the establishment of the procuratorial system,but also faced with some of its own conditions and constraints of the environment,has a unique personality.The third chapter mainly introduces the background and the basic process of the procuratorial system in the late Qing Dynasty in Hunan,focusing on the reasons why Hunan’s procuratorial system lags behind other provinces.The fourth chapter mainly introduces the establishment and practice of Hunan procuratorial system of Beiyang government,the procuratorial system of this period is the judicial system in the late Qing Dynasty inherited,not only with the establishment of the boom,has abolished the setback.The fifth chapter mainly introduces the development and practice of the procuratorial system in Hunan Province during the period of the constitution.In the process of modernization of China’s system,both eager to make progress,but also tend to be conservative side.Hunan Provincial Constitution Movement is a spectacle in Chinese constitutional history,in the promotion of inter provincial autonomy thought under the constitution of Hunan made public,the governor,has established a set of legal system to the political system,procuratorial system is also different from other provinces,Hunan can best embody the personality.The sixth chapter mainly introduces the procuratorial system of Hunan during the period of Nanjing national government.As the Nanjing national government in the form of the reunification of China,this period of Hunan prosecutors and the national procuratorial system basically the same.However,due to the outbreak of the war of resistance against Japan,Hunan is the main battlefield of the war of resistance against japan.In the last chapter,the author summarizes the characteristics,experiences and lessons of the modern procuratorial system in Hunan,and looks forward to the reform of the procuratorial system in Hunan.
