Study On Performance Evaluation Index System Of Government Of Law

This research studies across two subject areas of law and public administration. During ten years from 2004 to 2015,The State Council promulgated the “Implementation Outline for comprehensively promoting administration according to law”, and “Government by Law Construction Program(2015-2020)”. The party and the government’s major decisions and documents, without exception, have proposed that promote the rule of law government construction by evaluation and building up scientific and reasonable evaluation mechanism and indicators. In this paper, in response to this historical background of policy, the government seeks to introduce the concept of performance evaluation methods to construct rule of law and government performance evaluation system. Obviously, this research is full of theoretical importance and practical significance.Government Performance Evaluation System is regarded as “the world’s difficult problems”. This paper refers to several countries and areas’ evaluation system of the rule of law and experience, such as the United Kingdom, the United States and other Western countries (regions), Chinese Hong Kong and Chinese Taiwan, as well as mainland Guangdong, Hubei and other provinces’ administrative evaluation index system. The case reference is started on the objective evaluation of the logical starting point, based on the results-oriented and public satisfaction oriented, worked as a special case of AHP, and the use of expert advice of investigation, building objective indicators evaluation, expert evaluation, public satisfaction measurement with five first-level indicators(institution building, process propelling, achievement of objectives, cost of rule of law and satisfactory results), 14 secondary indicators and 41 third indicator. All of those indicators make a system of rule of government performance evaluation, after which being used empirical, and put empirical results to quantify and standardize test to further improve the indicator system recommendations. The results showed that the index system that “can be derived in advance, and can be testable afterwards” approach has broad adaptability and verifiable scientific basis.The rule of law Government Performance Assessment evaluation strengthens the value rationality. As the current evaluation of the rule of law is limited in internal evaluation, the indefinable objectives, the repeating and fragmented evaluation, and the complex issues of the index system, the transformation of the rule of law from the government target assessment to the government performance evaluation has an objective necessity, since the rule of law and the performance are in the same strain. As an tool of internal management, in order to basically achieve the 2020 goal of government ruled by law, the internal evaluation system should be positioned as a top-down objective evaluation of the performance-oriented, while clearly defining the relationship between the evaluation of the right, the right to organize and implement the right to introduce social appraisal, and promote the implementation of the right to an external evaluation. The external system should foster an independent third-party evaluation organization. Of course, any evaluation is essentially subjective, or as the saying one of the words. Whether strengthen governmental organizations to improve the management and the rule of law or the credibility of the government, the path of improving the indicator system is not the monopoly of the evaluation, but the open to the public of the right to evaluate and promote government information disclosure, so as to achieve the organic unity of the internal evaluation and external evaluation.The innovation of this thesis is in three aspects. Firstly, government performance evaluation method has been introduced in the evaluation of the contribution of the government of law, making the theory of government of rule combined with government performance evaluation methodology, deriving new concepts category. Secondly, it improves the method of Analytic Hierarchy Process, the importance of the single evaluation surrogates pair wise comparisons, innovative building technology path of indicator system. Thirdly, based on the empirical results of the indicator system of multiple program comparison and test, the system could be enhanced with more scientificity and convincingness.
