Study On The Farmers’ Social Security Right

Social security is a basic human right which has the characteristic of legal right and constitutional right and it is incumbent for the government to provide social security. Farmers, as the Citizens of the People’s Republic of China, naturally enjoy the social security right. However, under the circumstance of the dual structure in urban and rural economy, social security of farmers are marginalized by the whole social security system and the complete, coordinated development of the whole society is hindered. Therefore, strengthen the social security of farmers are not only reflect the urgent eagerness of farmers but also be the guarantee of social equality and stability on the new start of constructing socialist harmonious society. Based on the current study, this essay have proposed a integral conceive and specific measure through the analysis of transition and current situation of social security right of peasants as well as enlightenment from foreign examples and general rules. This essay is divided into five parts to elaborate this topicChapter 1, to elaborate the social security right is a basic human right and a citizen’s basic constitutional right and then elaborates the study of social security right of farmers. After the recognition of farmers’ citizenship status and analysis of household registration system, this essay elaborates the farmers should enjoy equal social security right and it is the demand of social security system, social equality as well as the showcase of great superiority of socialism with Chinese characteristics.Chapter 2, based on the recognition of right and system, that is, when citizens obtain a certain right, the social system right, especially the legal system changes correspondently to some degree, in that case, social security has a close relation with origin and development of social security system. This part made a conclusion through the study of development and history of social security of farmers, which the current social security is at a relatively low level, the legal and management mechanism is not complete and made a deep analysis of social security right of farmers from the perspective of economy, politics and views. Chapter 3, in the developed western countries, the social security system of farmer is a good reference to our country. While in today’s Western countries, farmer is considered as a career, the fundamental and specific conditions of implementation of Social security system are different, however, through the study of the social security systems,which is covered whole people or only the agricultural workers, analyzing the experiences in the evolution of the social security system of farmer, which will open our mind and improved our system’s science and rationality. Especially, established the social security systems of farmer in a country, agricultural population accounts for 70%, which is no precedent to follow in the international arena.the social security system of farmer abroad inspire us on following items:the order of establishment of rural and urban social security system; emphasized the role of government; stated the social security system of farmer in legal format; established a multilayer social security system of farmer.Chapter 4, put the achievement of the social security system of farmer forward, settle the base of following parts. First of all, the establishment of the social security system of farmer is not only for equity but steady; secondly, considered of the population, development and lopsided, balance urban and rural development is the only choice; thirdly, make sure the insurance multilayer social security system of farmer; fourthly, strengthened legal insurance of social security system of farmer; fifthly, emphasized the role of government: including its system of supply responsibility, fiscal responsibility and management oversight responsibility.Chapter 5, partition farmers to agricultural worker, farmers without farm and migrant workers, on this basis, I give different ideas for their social security requirement. For agricultural workers, endowment insurance, medicare and minimum living security are necessary, to achieve convergence of urban and rural social security system. To those who had no farm, improved of earth confiscation system, employment security and urbanization are the guidance. For migrant workers, injury insurance, endowment insurance, medicare, Unemployment Insurance and minimum living security system are precondition to integrate them into industrial workers.Finally, on the last part of this article, focusing on the Chengdu and Chongqing as a national urban and rural areas comprehensive reform pilot, made a useful innovation on some aspects of the key areas and key links, while exploring the development of urban and rural social security. And also Pointed out the existing problems and corresponding solution in explaining the basis of practical experience.
