China's CBM Industry Regulation Research Under The Current Technical And Economic Conditions

The paper is mainly based on the extensive collection of the CBM regulation practice domestically and abroad. According to regulation theory, CBM technical and economic conditions are often regarded as the premise, sustainable development as a basis, the research has fully benefited from the coal-bed methane experience in some areas in order to explore the establishment of suitable China's CBM industry and regulatory conditions, to regulate coal-bed methane business practices,to perfect the technical and economic conditions of the current regulatory system established under the procedures, contents and methods for rational and effective development as well as utilization of coal-bed methane, to ensure economic and social benefits.The research achieved the following results:First, based on the system of natural monopoly theory, regulation of economic theory, contestable market theory, the theory of sustainable development theory, defined the conditions for development and utilization of coal-bed methane resources: Resources are the foundation while regulation is the guarantee.Second, through the systematic analysis of rapid development of CBM industry regulation practice in the United States,Canada, Australia, Britain and other countries, the paper has acquired the following revelation:Regulation Legislation for the regulation system has laid a reliable foundation; quasi-developed infrastructure and pipe network into policy development for the coal-bed methane industry conditions; opening market could stimulate competition; strengthening social regulation is beneficial to sustainable development; it's necessary to encourage diverse investment; CBM requires sophisticated pricing system.Third, China's coal-bed methane resources are abundant but in low utilization, on the basis economic characteristics of coal-bed methane resources and existent regulation, there are advantages and disadvantages in the evelopment and utilization of resources. At present, state-owned enterprise with much financial support and local enterprises with many resources; CBM technical development and construction of supporting facilities are still under grandul perfection; the market of CBM is prospects. CBM development requires regulation of "escort" in order to achieve a reasonable development and effective utilization.Fourth, with the systematic analysis of the problems concerning the mineral rights of cross-regulation in coal-bed methane, imperfect pipeline construction, no methane price system, limited investment channels, the lack of coordinating the development regulation, what's more,social regulation and other related issues need to be strengthened. The paper has concluded that CBM regulation needs an independent regulatory agency or a department with the specific responsibilities to undertake enforcement actions; need basic law toabide by. It has come up with a feasible solution which includes investment regulations, foreign cooperation regulation, price regulation, taxes, fees, subsidies, entry and exit regulation, social regulation and other eight areas of specific regulatory approach and content, forming a perfect regulation of entry and exit, pipeline construction competition, regulation, standard CBM pricing regulation, broadening the investment channels for regulation, the enterprise effective regulation and improving the safety and environmental protection as the main content of social regulation and soon.Fifth, through in-deep analysis of the preliminary findings of the development of coal-bed methane industry in Shanxi Province,the above initial regulations are feasible in practice under the present technical and economic conditions.
