The public interest litigation is an important problem, which attract extensive attention from the whole society. It breaks down the traditional litigation ideas and the litigation claims of the systems, continuously improving the judicial reforming activity in the world. In our country, the trend of the public interest litigation is increasing. It has been challenging our Chinese legislation and judicial systems. It has been directly related to the protection of the rights, the stability of the society, the function of the judicial and the other such kinds of major issues. In order to open up the way for our protection of the public benefits, fill up the legislation blanks and legal loopholes, and in order to reasonably dispose the judicial resources, we should provide the theory supporting the indirect formidable relations to enter the judicial relief procedure, so as to promote the position of protection of rights of social vulnerable groups, carry through the idea of the social justice.
