Analysis On Legal Culture Of Chinese Guardianship System

This text studies on Chinese guardianship system, and tries to find and sum up the evolution rules of guardianship system through the analysis on legal culture traits of guardianship system in different periods. This text is a useful investigation to the development of our guardianship system in the future.Part one introductionThis text adopts the conception of guardianship system in broad sense. In concrete analysis this text discusses around four problems hereinafter: (1) the guardianship of parent to children or minor children; (2) the guardianship of the person except parent to the young person; (3) the guardianship of the adult; (4) the guardianship of woman and the guardian right of woman. The modern guardianship system protects the interest of the ward, also protects the interest of the guardian and the third party in good faith. Guardian enjoys rights and takes on obligations. But the rights and the obligations of guardian varies with the state of ward.Guardianship system is the outside representation of the legal conception which man develops during long legal practice. If we analyze the legal culture of guardianship system we can recognize the essence of guardianship system from broader visual field and sum up the evolution rules of guardianship system more scientifically.
