The main purpose of this diesis is as to observe the historical evolving process of social control in ancient Chinese society from the angle of legal sociology as, based on it, to reveal the various social control ways in ancient china, especially the function and relationship among three mam means-law, morality and religion It also provides some basic clues for people to understand and observe social control condition in ancient China bv the induction of the historical facts and the description of the fundamental situation of social control system, as well as by the summery and conclusion of the features, essence and developing regularity of social control in ancient China. Combined with the historical observation of the social control pattern in ancient China, it puts forward a presumption of how to seek the historical experiences for reference from the national resources and also give a corresponding demonstration.It includes one part of introduction and other six chapters. The Introduction mainly discusses the relationship between social order and social control, for the purpose of explaining the indivisible inner connection between them, expounding that the purport (gist) of this thesis is to observe the historical evolving process and main social control means in ancient China from the angle of legal sociology, and illustrating the significance of this thesis from both the practice and theory.The first chapter, the general introduction to the theory of social control. It gives the historical study on the notion of social control and interprets its meaning, types, means, ways, significance and functions etcThe second, the historical evolvement of social control in ancient China From the observation of the historical development and its feature of social control from the primitive society, remote antiquity, the Period of Spring and Autumn, to the Dynasty of Qin and Han and the following different feudal periods, it expounds the official ideology in rule and the legal guiding ideology. It studies the theoretical system- strengthening the belief in destiny and defending the rule of imperial power-which went through the history of ancient China and safeguarded the system of autocratic monarchy. It also summarizes the order of " rule by etiquette" and the development of national legal system and folk law in ancient ChinaChapter 3, the function and role of law in Chinese ancient society. It studies the function of law and its characteristics in Chinese ancient society. Chinese ancient law from its value is regarded as "the tool of ruling people"; from the role of safeguarding the social order, it defends the absolute power of kings, protects the social order guided by the rulers, and standardizes the economic order and the behavior of judicial official, in its practicing process, it is displayed in the way of legal emphasis on the nation and cruel punishmentChapter 4, the function and role of morality in ancient Chinese social control. While introducing the different idea about moral instruction in our history, it also studies the important function ot morality in the ancient Chinese social control, the way mat Chinese ancient society so much stressed the moral instruction, and the relationship between morality and law in ancient China.Chapter 5, the function and role of religion in ancient Chinese social control Through the historical observation, it argues that China is a country with a tradition of religion and gives a comprehensive explanation about the evolving process of religion in ancient China, the function and role of it, the features of Chinese religion, especially the relationship between Chinese ancient religion and lawChapter 6, the choice of social control pattern in contemporary China. On the basis ot historical study on the social control pattern in ancient China, it lays equal stress on both "rule of law' and "rule bv morality' as well as the protection and encouragement by law to the normal religious freedom, which should be the best choice of social control pattern in contempora...
