Research On Personal Information Protection In Mobile Medical APPs In China

The 19 th session of National Congress of the Communist Party of China clearly put forward the strategy of "Health China" and the new initiative of "Internet + Medical",which highlights the role of Internet medical treatment as a complementary medical treatment,and the mobile medical app as an important part of the Internet,its contribution to the mobile medical industry is also significant.As an important part of the Internet,mobile medical app is also very significant to promote the mobile medical industry.China,as one of the countries where mobile health care is developing fast,also realizes that personal information security is the basis for the sustainable development of mobile health care industry in the process of its development.Compared with other types of APPs,the personal information involved in mobile medical APPs contains more personal sensitive information and contains higher value of personal health information,in which the risk of information leakage is greater and the consequences are more serious.In the background of big data era,how to protect personal information while benefiting from mobile medical APP has become an urgent problem,therefore,this paper selects the issue of personal information protection in mobile medical APP for in-depth study.Firstly,this paper compares the current situation of domestic and foreign research on personal information protection in mobile medical APPs in China through literature research method,and defines the definition of mobile medical APPs and the concept of personal information rights in them,and also elaborates on the theory of data privacy protection and the theory of information self-determination.Secondly,the current situation of personal information protection in mobile medical APPs is investigated from three perspectives of legislation,platforms and users: firstly,China’s mobile medical personal information protection regulations and policies are sorted out through literature survey method,and three aspects of personal information protection regulations,medical big data privacy protection and mobile medical regulatory system are elaborated respectively;secondly,the privacy policies of 15 mobile medical APPs in China are compared and analyzed through textual analysis.Secondly,we analyzed the privacy policies of 15 mobile medical APPs in China through text analysis,divided the privacy policy text into 4 thematic items: basic privacy policy,collection and storage of information,sharing,transfer and public disclosure of information,and users’ information rights,and further subdivided the 4 thematic items into 17sub-items;thirdly,through questionnaire survey,we understood the current situation of personal information protection of mobile medical APP users in China;again,we combined the above three perspectives to categorize the current situation of personal information protection of mobile medical APPs.Finally,in view of the above shortcomings,we propose that the protection of personal information of mobile medical APPs should be improved by the state,the platform should reduce the risk of information security,and the users should improve their own security awareness.
