Legal Research On Ethics Review Committee System Of Medical Institutions

With the continuous development of medical science and technology,there are many ethical problems in R &D technology and medical trials.In order to find a relative balance between scientificity and ethics,and make science and technology develop in an orderly and healthy way under the ethical framework,the ethical review committee of medical institutions has been created and developed in various countries,through which the ethical review and supervision of clinical trials are carried out,To play an important role in protecting the rights and interests of the subjects.China has established the ethics review committee of medical institutions and issued a series of legal documents to regulate the review behavior.However,there are still many difficulties and deficiencies in the operation process,and there is a big gap in the system construction compared with some western developed countries.Through literature research,comparative research and interdisciplinary research,this paper combs the relevant concepts and characteristics of the ethics review committee of medical institutions in China,and analyzes the development process and characteristics of the ethics review committee of medical institutions at home and abroad,This paper analyzes the legal system of ethical review in the United States,the United Kingdom,Australia and other countries,the special bill in the United States to regulate ethical review,and the independent ethical review in the United Kingdom,Australia’s ethical review and supervision mechanism has a positive reference significance for the relevant legal system of the ethics committee of medical institutions in China,and puts forward that the construction of the legal system of the ethics committee of medical institutions in China should improve the effectiveness level from the legislative aspect,increase the relevant provisions on the protection of rights,and clarify the supervision subject of the ethics review committee of medical institutions in the supervision aspect Supervision responsibilities and the construction of the accountability mechanism of the ethics review committee of medical institutions.
