Research On The Legal System Of Biological Terrorism Prevention And Control

When a major public health emergency breaks out,no country or region in the international community can be“immune”and will be more or less affected by the event.Especially when a major infectious disease is raging around the world,all countries are inevitably involved in the war without smoke.With the development of globalization,international relations are getting closer and closer.When dealing with such a major public health emergency,if only one country acts alone,it is bound to fail in the fight against the epidemic.However,when the international community follows the law and works together to prevent and control the epidemic,it will be the most fundamental strategy to defeat the epidemic.From the legal perspective of international cooperative prevention and control,this paper analyzes the deficiencies of international cooperative prevention and control in major public health emergencies from the perspectives of the international community and regional organizations,and puts forward countermeasures.In the writing process,empirical analysis,literature analysis and rule comparison methods are mainly used to study the construction and improvement of the legal system of international collaborative prevention and control.This paper is divided into five parts.The first part is the introduction,which mainly introduces the background of the question and explains the current research situation at home and abroad.The second part is an overview of the current situation of international coordinated prevention and control.The third part explains the leading and coordinating role of WHO in the coordinated prevention and control,and puts forward specific suggestions to improve the leading position of WHO from the perspective of legal system in view of the problem of its insufficient leadership and coordination.The fourth part introduces in detail the regional collaborative governance model that plays a supplementary role,and according to the shortcomings and challenges of regional collaborative governance,puts forward the argument that it is necessary to improve the legitimacy and effectiveness of regional collaborative governance from the legal system.The fifth part,from the perspective of the rule of law,puts forward four measures of the rule of law that must be implemented in the international cooperative prevention and control,that is,to give governments the right of security,properly handle the relationship between state power and individual rights,follow the judicial justice,and improve the transparency and accountability system.The sixth part is summary and prospect.This paper focuses on international collaborative governance and regional collaborative governance,with the aim of building a multidimensional international collaborative prevention and control to deal with major public health emergencies and solve the current epidemic prevention and control problems facing the international community.This paper also focuses on the analysis of various problems in the international collaborative prevention and control,and from the specific legal system construction,further improve the international collaborative prevention and control measures,truly achieve the combination of points and aspects,promote the concrete implementation and comprehensive development of international collaborative prevention and control.
