Devolution Of Law Enforcement

In China,the district offices,as the foundation of the administrative department,play an important roll in the area of public administration,community planning,society management.The function and the scale of operation of the district offices have been changing a lot due to changes of the political environment in China,however,the human resource,financial resource and the related authority haven't been increased accordingly over the years.Therefore,the responsibility of the district office does not match with it's current authority and resources.The No.1 Topic has been implemented since April 2015,which is an institutional reform of the district offices.The “1+6” reform took off the economic development function of the district offices,in the mean time,the district offices have been entrusted with more authorities of human rights and the rights of decision making.The structure of the district offices transformed from the traditional top-town hierarchical to the new bottom-up approach.This article will start with a detailed explanation of the administrative level of the district offices and the source of its power;and then,follow up with the analysis of the new functional structure and the new authority of the district offices after the reform.Such analysis get to the conclusion of the main problem of the operation of the district offices,which is the imbalance between the responsibility and the authority.Furthermore,with respect to the centralized implementation of law,the author did comprehensive study regarding the reduced implementation power of all the levels of the government organizations in Shanghai.Thepurpose of this article is to grope the responsibility of the district offices,to clarify the structure,standardize the operation,to improve the ability of implementation of law,in order to improve the function,authority of the district offices along with a clarified and legalized responsibility.
