Research On The Conflict And Balance Between Press Freedom And Privacy Right

With the development of society,the Internet has gradually become widely applied.At present,the total number of Internet users in China is at the leading level in the world,but what follows are some negative phenomena caused by the Internet.Freedom of the press is of great significance in the improvement of the construction of democracy and the rule of law in our society;and the citizens' right of privacy,as a component of civil rights,has gradually been emphasized by the constitution.Freedom of the press and right of privacy conflict with each other but meanwhile exist independently in society.The contradiction between the two is mainly reflected in the fact that the meaning of the freedom of the press lies in exposing some individual or collective behavior to the public,and allowing the citizens to criticize them from the moral point of view;while the existence of the right of privacy is to protect people's private information,prevent it from being disclosed to the outside world and effectively protect rights of citizens.In the current laws of China,the relevant provisions of news rights are still not perfect,which makes it difficult to define the freedom of the press and the right to privacy.As a result,there is often conflict between the two in practical work.At the same time,as the freedom of the press and the right to privacy are directly related to the citizen's personal information,how to handle the relationship between them is very important.Especially in the case of implementing the basic national conditions of the rule of law in our country,our country should strive to find a balance between the freedom of the press and the right to privacy,to ensure the coordinated development of both,and not to impair the basic boundary of the rights.Therefore,on the basis of a detailed analysis of the manifestations and causes of conflicts,China should define the boundaries of rights clearly,seek the balance between freedom of the press and privacy protection to maximize the value of both parties.And we should define the scope of the two parties and try to avoid and reduce the emergence of conflict,so as to provide the possibility of the balance of freedom of the press and the right of privacy.
