In the West,research on domestic violence has passed more than 30 years.However,in China,domestic violence as a foreign word was only gradually accepted by some Chinese scholars who studied domestic violence in the 1990 s.In China today,domestic violence has become an open issue.The Chinese government has paid attention to domestic violence and has formulated and promulgated a series of policies and laws on domestic violence.As many scholars and practitioners have pointed out:In all forms of domestic violence,such as physical violence,spiritual or emotional violence,sexual violence and economic violence,mental violence is the most common form,but our country has not yet clearly defined the family.The meaning of mental violence.The author intends to conduct a more systematic study of the legal nature and legal regulation of family violence,and to provide a theoretical basis for the better design of the system by drawing on the relevant provisions of other countries and regions and combining with the specific conditions in China.The practical recommendations focus on the legal regulation of the status quo of domestic violence in our country.In addition to the conclusions,this article includes a total of five parts.The first is the introduction,including the reasons for the topic and the significance of research,literature review,the research ideas and methods of this article,and innovations.A total of four parts of the text are progressively advanced.The in-depth analysis of the problem of domestic violence is intended to propose the most effective and effective legal advice on the regulation of family violence.The first part of the text reviews spiritual violence,specifically including the meaning,characteristics,forms of expression,criteria for identification,and causes of mental violence.The second part of the text mainly analyzes the status quo of domestic family violence in our country,adopts legislation and practice of spiritual violence.The analysis sums up the difficulties and problems facing the legal regulation of family violence;the third part of the text compares the legal regulation of family violence in the Anglo-American law system,the common law system and the Taiwan region of China,and summarizes the situation in China.The legal regulation of extraterritorial family-spiritual violence has implications for our country;the fourth part of the text puts forward suggestions for legal regulation of family violence in China from the perspective of legislation,law enforcement,and social security systems,in order to truly eliminate family-based violence in society and achieve Real equality and harmony between people.
