The Status Quo Analysis And Countermeasure Research Of The Police Power Operation Mechanism In China

With the deepening of policing reform, this thesis will analyze the evolution of operating mechanisms, the current situation and the problems of police power. In addition,this thesis will furtherly analyze the new model of the policing reform in Nanjing with foreign and domestic experience. At last, this thesis will spread out a discussion and a research on the improvement of the operating mechanisms of police power in China.In this thesis, the author implements the spirit of the congress of the Ministry of Public Security about comprehensively deepening policing reform. On the one hand, from the perspective of conceptual desgin, this thesis, using foreign successful experience, will explain the social background, emergence process, develpment history and the operation effect of policing reform in a dynamic and historical view, in order to sum up some experience and lessons to accord with China national conditions. On the other hand, from the view of practice, this thesis will study two cases, Public-Opinion-Monitoring system and E-Police pattern, which are carring out by Nanjing police, to find a new policing model which is more closely aligned with the reality. At last, according to the relevent literatures and his own experience, the author will give proper strategies for the operating mechanisms of police power.To be specific, this thesis consists 5 parts. Based on the theory of public management,the first part talks about the concept and the characters of police and police power. In the second part, it analyzes the prominent problems which exists in the operating mechanisms of police power. The third part evaluates the new policing model in Nanjing and brings forward some new ideas on the subject of law enforcement supervision mechanism and police activities management. The forth part picks 3 typical countries to dynamically analyze the emergence backgrounds, management mechanisms and operating features of police power. In the fifth part, combining with relevent literstures and professional knowledge, the author puts forward some suggestions on the operating mechanisms of police power, including division of police power, legal support system, police model innovation, law enforcement supervision system and the establishment of the system of preferential treatment for police officers.
