On The Legal Status Of Women In Marriage And Family In Song Dynasty

The traditional culture of our country always advocates the view that men are superior to women and that women are required to comply with three obediences and the four virtues,being loyal and steadfast preserve chastity after the death of her husband.Especially after the rise of neo-Confucianism,as women were constrained and depressed more,the Song Dynasty is therefore considered as the period the status of women was in a sudden turn for the worse.However,this is not the case.The legal status of women in Song Dynasty not only did not decrease,but increased to a certain extent.Generally speaking,women's status in marriage and family is the reflection of their legal status in the whole society,therefore this paper focuses on women's legal rights in marriage and family in Song Dynasty.Through the study of women's legal rights in marriage,family and inheritance,this paper will show the change of the legal status of women in the Song Dynasty,and analyzes the formation causes and effects of this change.This paper consists of three parts: introduction,text and conclusion.The introduction mainly introduces the significance of studying the legal status of women in Song Dynasty and the present situation of the research on the legal status of women in Song dynasty.The last part is the innovation of this paper.The first part of the text is the legal status of women in Song dynasty.The first is about the marriage system in the Song Dynasty.Song Dynasty's legal provisions of the dowry reveal that when women get married,they can get rich trousseau from parents' family to improve their status in husband's family.Next is the liberty of the female divorce.In addition to the succession of the Qi Chu,Yi Jue,He Li these three forms of divorce,it also provisions terms which women could divorce.The last is women's freedom of remarriage.In Song dynasty literati's chastity is weak.Although neo-Confucianism emerged in the Song Dynasty,it has not yet formed the dominant ideology.So in Song Dynasty remarriage is very ordinary.The second part is the legal status of women in Song dynasty,including mother right,property right,the right to education these three aspects.This is the main worship of filial piety,from the authority,mother to child heir right view of women as mothers in the legal rights;property rights are mainly female ownership for their dowry,the family property management rights,women and men can participate in social labor;the right to education of female learning not only is the female virtue also includes cultural knowledge,Song Dynasty appeared outstanding female poet.The third part is the legal status of women in Song dynasty.First of all,to distinguish from the main female admiral wife and daughter,daughter is further divided into the unmarried and married women,married women.The law of the Song Dynasty on the inheritance of women's property is very detailed.This is the extension of the right of property inheritance inheritance rights of married women.The expansion of property rights is a direct manifestation of the rise of women's status.The fourth part is about the legal status of women in marriage and family in Song dynasty.According to the above discussion,the author points out that the legal status of women in marriage and family in Song Dynasty has been promoted,and the reasons are analyzed from three aspects: the development of commodity economy in Song Dynasty,the popularization of culture and education,and the improvement of legal system.Finally,it discusses the influence of the promotion of women's status in the song dynasty.
