The Property Rights Of Women In The Song Dynasty

In the history of China, the Chinese women were always in the lower state, comparing to the men. In ancient times, the property rights of women were always attached to their parents and husbands. The Song dynasty, there was a popular phenomenon, which was that the people would gave their daughters a lot of money in her marriage, and those money would carried by the daughters into their husbands.Speaking to those money, they were obviously different of the money belong to the husbands. And I think, in the Song dynasty, the property rights of women were different to other dynasty, because of the specific phenomenon.Since women were born, they would be doomed to be three roles, which were daughter, wife and mother. According to the three roles, I divided the article into three chapters:Chapter 1:Introduction:I discuss the concept of the women property rights in Song dynasty, and the research current situation, and the research methods and the significance of the paper.Chapter 2:According to historical material, I discuss the girl as a daughter, who got the property rights from her parents. In this chapter, there are some situations. First of all, I discuss the property which the girl got from her parents, where the property from, and who actually have those, even involved the window and divorced women. I apply lots of historical material, and laws and cases in the Song dynasty to describe how were people or leader in the Song dynasty deal with the marriage property stuff. Second, the article described some special phenomenon, for example of the son-in-law, who must take care of the parents-in-law. In essence, the married women got the property from their parents, in the way of the son-in-law who got property. Finally, the article divides woman into three classes, which are the woman, the marriage woman and the divorced woman, in order to discuss the intestate succession.Chapter 3:According to the historical material and empirical analysis, I discuss that women got the property rights from husbands. In ancient times, the women were belonged to the men, and the property was all in the handle of the men. But if the women became window, they could get the property. This chapter discuss the window who remarried or not remarried, would get the different property rights. Of course, also consider of some specific cases, for example the window married with the men who belonged to ex-husbands and the property rights of children who given birth by concubine.Chapter 4:According to the historical material and empirical analysis, I discuss the rights of the women as the mother. The part includes the responsibility of the son who must take care of the mother, and the rights of the mother with the ownership and management in the family. Even the mother has the inheritance with the son.Chapter5:Conclusion:I summarize the whole paper, and discuss the women social status in Song dynasty by the way of the property rights.
