| With the development society, it is very necessary to solve problems about excessive medical treatment. Not only can it lead to the rise of health expenditure, but it can waste the health resources and affect the doctor-patient relationship. A large number of patients believe that it is hard for them to go to doctors and they must spend much money on it. However, medical workers also face the same difficulties. In modern society, medical incidents occurred frequently and medical dispute cases rise day by day. However, it is hard to deal with problems and achieve the balance between medical workers and patients based on relevant laws, leading to many adverse consequences. It is another reason that medical workers don’t have noble ideological and moral cultivation. From the patient’s perspective, they don’t trust the medical workers; patients are too harsh to them and have strong awareness of rights. The phenomenon about excessive medical treatment deserves our concern.The article analyzes the reason why excessive treatment exists, including medical institutions, medical workers and patients by studying theories about excessive treatment and informed consent, including the definition, essence and characteristics of excessive medical treatment, forms of excessive medical tort, analysis of informed consent theory, structure and development process, by the longitudinal comparative study includes the stage of China’s legal norms, including the exploration stage, establishment and perfect stage at the same time. Compared with advanced experience of excessive medical treatment abroad, excessive medical treatment and informed consent form and the relationship will be listed, including physicians, violations of the law to fulfill this obligation, the existence of medical damage in patients with medical malpractice and illegal facts and fulfill the causal relationship. Analysis from the perspective of national regulations, medical institutions, medical workers and patients is made to solve the problem of excessive medical treatment in China. |
