Under the new situation,strengthening the protection of cultivated land is becoming more and more popular and highly valued by the society.Land and resources law enforcement and supervision is an important means and effective measures to strengthen the protection of cultivated land resources,the illegal destruction of arable land in the abuse of land has a strong deterrent and restraint.But in recent years,with the rapid development of economy,the protection of cultivated land resources pressure more difficult,illegal occupation of arable land behavior further intensified,the land and resources law enforcement and supervision work face more severe situation,in practice there land and resources law enforcement duties investigation difficult,investigate implementation difficult and responsibility for the implementation of the difficulties.The main research contents and results are as follows:(1)the elements of the illegal occupation of arable land,disposal,and other aspects of the investigation were determined,established a theoretical framework of illegal occupation of arable land administrative law enforcement.Scholars,policy documents and study of relevant laws and regulations through the analysis from theory aspects of combing the farmland,farmland protection,illegal occupation of arable land and other related concepts,and puts forward the illegal occupation of arable land behavior of four constitute elements and list and summarizes the illegal occupation of arable land act set mode,expounds the illegal occupation of arable land,regulators to investigate,for land and resources law enforcement and supervision of investigation supervision,provide a theoretical basis.(2)reveals the spatial and temporal structure of the illegal occupation of arable land in Shaanxi province and the emergency measures.According to the Shaanxi Province from 2011 to 2015 years of illegal occupation of cultivated land statistical data,through the research and analysis of behavior of illegal occupation of cultivated land forms,and characteristics and the causes of illegal occupation of arable land to be a profound analysis;the Shaanxi Province illegal occupation of the main reasonsfor the grim situation of cultivated land is affected by land management system,relevant laws and regulations lag,spreads of different land uses,punishing mechanism under deterrence,law enforcement to monitor the work itself is insufficient.For the next step put forward feasible countermeasures which is the realistic basis.(3)based on the theory of illegal occupation of cultivated land and the statistical analysis of the case,the illegal occupation of arable land to prevent countermeasures.From the perspective of laws and regulations,institutional mechanisms and management means as a starting point,pay attention to land law enforcement work encountered in practice in the process of the practical difficulties of solution is proposed,the "unspoken rules" resolve to deal with and how to fully mobilize the soft environment construction of law enforcement personnel working enthusiasm of management,strengthen the authority of land and resources law enforcement work,improve the law enforcement to monitor the actual performance security.
