The competition between the enterprises outstanding performance for intellectual property rights.Company’s products obtain eternal development by constant innovation, but innovation is necessary to break layers of patent barriers set by competitors.Design around not only can help companies to analyse the current trends in technology development, look for hot technology,but also can help companies to develop core technology products with independent intellectual property, develop the patent barriers.Designed use design around in the initial design in order to avoid patent disputes arising.Primarily design around are mainly for a single patent and the group of patent, Although the design of the structure can be averse to meet the requirements, but design for a single patent can avoid of certain patents and the group of patents can avoid a technological base, not the group of core patents;thus result of design around still has the risk of patent infringement. Today, product innovation not only from a legal perspective but also introduction of TRIZ and other innovative approaches to design around.Help designers quickly generate innovative ideas and problem-solving tools by using TRIZ.However, the method for determining the scope of avoiding is still lack the fast and efficient method to find.For the problems currently exist of those design methods, this paper proposes a design around process from the technology of core patents which can avoid patent barriers from the source.The main contents include the follows:1. Summarizing the current search patent retrieval methods, combined with those lacks to propose a method of screening criteria to determine the exact keyword approach.Meanwhile determine IPC, the IPC with the exact keyword Boolean operations to patent search,lastly obtaining patent library.2. Determine the methods of patent analysis. Due to get the core technology in the field of patents from patent library.Usually the core patent technology in the formative years of the life cycle, through making Patent technology life cycle to determine patent in formative years of patent technology life cycle.There are many methods to find core patents,but the most effective way is citation analysis.Using patent citation analysis to determine the group of core patents.By the patent citation analysis to determine the core patent group of the formative years of patent technology life cycle.3. Proposing a method to determine the scope of design around based on the group of core patents.By establishing the system structure trees and function trees and building Module-Function table to determine the scope of patent design around. Analysing components and their functions to determine function type and functional level of component, then resolving problem to obtain new program via TRIZ and infringement.So determining a process of design patent based on the group of core patents.4.
