Study On The Construction Of River Basin Ecological Compensation Mechanism And The Related Legal System

With the deterioration of the river basin ecological crisis in the21stcentury, people come to realize the importance of ecologicalcompensation. Ecological compensation plays a great part inenvironmental protection, economic compensation in the upper reaches ofriver, and realization of the sustainable development. Therefore, thetheoretical and practical spheres in China have done a lot of research intoecological compensation. However, China has not yet established acomplete legal system of ecological compensation. In practice, little studyhas been done in the mechanism of market participation. The research isbasically limited to fragmental exploration and monotonous app roach,lacking long-term profit-incentive mechanism. From the perspective ofmarket participation model, this thesis, starting with the economicalcompensation, explores the public goods theory, externality theory ofeconomics among other related economics theories, as well as legalsystem, property rights, law enforcement and the judicial system, andother laws of ecological compensation. Combined with the theoreticalstudy, examples of ecological compensation both at home and abroad arealso cited. Based upon the analysis, the author puts forward an ecologicalcompensation with market participation, which connects economic profitswith ecological benefits, and analyzes the laws that should be urgently enacted.
