Research On Grassland Desertification In China And Its Resolution

The total area of grassland in China is only next to Australia, ranked second in the world. The grassland area accounts for two fifths of the territory in our country, natural grasslands cover nearly one fifth of the land area. The grassland resource,as the larger terrestrial ecosystem,is not only the focus of China’s ecological environment construction area, but also has an extremely important ecological functions and economic significance to protect the basic areas of biodiversity, and promote China’s economic construction and sustainable development of society. In order to protect human valuable natural resources, promoting the gradual recovery of the grassland ecosystem function and healthy development is not only conducive to the construction of a harmonious society in China, but has an important significance on the maintenance of the human living space and the living environment.In recent years, with the accelerating pace of economic construction, people’s awareness of environmental protection weakened, the dependence of the various resources of the grassland areas increased, management measures in grassland areas are not organized, existing problems as various constructions and management of grassland resources, the prospects for the development of grassland is really worrying. The vast grassland with green grass and clean water of the scene is now no longer exists. China’s grassland is facing a serious ecological crisis as the grassland area is shrinking, the quality is lowering in different ways and the destruction of grassland have grown, grassland ecological environment have become increasingly prominent, resulting grassland desertification will be in all areas of society concern, the law of grassland desertification prevention and treatment will gradually become an important issue.The dissertation has recommended the definition, type, status quo, harm of grassland desertification under the grim situation of China’s grassland desertification, and further analysis many factors that affect grassland desertification.By analyzing the comparison we drawn the main reason for China’s grassland desertification is the human factors and grassland human disruption has a profound social and economic causes, through in-depth analysis of the reason is to find a more appropriate legal solution. Currently, there is sound grassland protection legal system, but with the destruction of grasslands behavior of new types of emerging, the law of grassland desertification prevention and control measures can not be effective contrast to adapt. Through inductive analysis shows that, in our grassland legal system legislation, law enforcement and the grassland legal system still have many deficiencies and shortcomings, as to the anti-desertification Act has limitations, confliction in relevant legislation, the legal responsibility of the destruction of grasslands is not clear, accompanying the local laws and regulations are not perfect, grassland supervision and implementation out of practicable, grassland protection is insufficient, the lack of grassland desertification prevention and control of special funds, ecological does not produce imperfect mechanism of grassland resources through administrative coordination mechanism is unreasonable, the single subject of grassland management and grassland resources through ownership system is imperfect, and other issues. To solve the above problems, this dissertation has done the analysis and exploration on prevention and treatment of grassland desertification legislation, law enforcement, the legal system, and learn from the experience of the prevention and treatment of the three typical countries of the United States, Australia, Israel, and suited to China’s national conditions and legal thinking, summed up the China’s legislation to combat the grassland desertification issues, law enforcement and legal system aspects need to be improved, namely to establish a sound and relating grassland legislation,to strengthen the administrative law enforcement of grassland management and to improve the grassland management laws systems.
