A Study On The Administrative Law Enforcement Of Illegal Private Educational Institutions

Private education is an important component in the cause of the socialist education. The rapid development of economy has led to more fierce competitions and shorter intervals for the upgrade of information. People begin to face more pressures and need to enrich their knowledge so as to follow the step of social development. In this circumstance, various kinds of private educational institutions come into being and begin to develop annually, followed by some serious problems, such as unlicensed foundation of these institutions.National laws and regulations have entitled the educational administrative departments to the management of private educational institutions. Therefore, the administrative departments shoulder the responsibility of supervising illegal private educational institutions. If not replying to the accusation of these illegal institutions, the administrative departments will be trapped in an embarrassing situation of administrative omission. However, in real life, it is not often the case where illegal private educational institutions are punished by these departments. The reason lies in the fact that the educational administration and law enforcement are hard to be carried out on illegal private educational institutions.Through illustrating the cases of educational administrative enforcement of law on illegal educational institutions in the city of C, the paper is intended to clarify the educational administrative enforcement of law in different procedures so as to search for the problems during the enforcement of educational administrative laws, such as the delayed term of time, difficulties in the investigation and evidence collection, long time period in legal aid, and the ineffectiveness of mandatory enforcement. Besides, causes of the appearance of these problems are analyzed.Based on the introspection of the causes of the difficult enforcement of educational administrative laws on illegal private institutions in the city of C, this paper focuses on improving the law enforcement on illegal educational departments and proposes some strategies and suggestions in terms of amplifying the legal system of education, enhancing the efficiency of educational administrative enforcement of law, improving the construction of educational administrative teams, strengthening the supervision on the enforcement of law, and conducting joint execution of laws. It is hoped that all these measures will be of great benefit in improving the law enforcement on illegal private educational institutions.
