The Study Of China's Administrative Accountability System

The rule of law and building a socialist country ruled by law has become a basic strategy of governing the country, which is the magnificent goal of the Chinese people for a century. In the new period, the party and the government have repeatedly stressed that the establishment of an administrative accountability system, which has offered an opportunity for the establishment of China's administrative accountability system. What's more, the "SARS" Event has accelerated the construction of China's administrative accountability system. Although administrative accountability should focus on both "inquirement" and "punishment", but should focus on "inquirement" more, as it is an inevitable demand of its pre-defense function. We do not need the GDP produced from swears hops; we do not need such economic development at the cost of our lives; we even do not need a society which involves post-processing of several government officials'accountability; because they can not comfort those souls killed unjustly. Although administrative accountability system needs ascertain where the responsibility lies, we need a mechanism which emphasizes the"pre-and-halfway inquirement"more.Administrative accountability should reflect the principle of consistence between the powers and responsibilities which not only includes the consistence among the powers, duties and responsibilities, but also doing duties. The Chief Executive, as a key leadership position among civil servants at all levels of the administrative organ, should establish a sense of responsibility, take the initiative to handle their own work and carry out the laws and regulations seriously, rather than assume responsibility passively because of the constraints of administrative accountability system. It should be made clear that the "responsibility" in administrative accountability means"doing duties", not just "take responsibility". Moreover, punishing accountable officials does not mean the end of their political life and accountable officials'comeback is covered by such a rational system.Because of the difference in the basis, scope and terms of accountability targets when formulating the measures for administrative accountability, the practice patterns are quite different across various regions. In one place, what should be covered by the accountability act may not be applicable in another place. The different results raised by different scale of accountability could undermine the credibility of the government. That is why it is a necessity to formulate a uniform Administrative Accountability Act throughout the whole nation.Under the guide of Marxism's practical materialism and the basis of the combination of theory and practice, the writer of this paper has used those following methods: the combination of empirical analysis and normative analysis, the linking of historical analysis with inductive logic, comparative analysis and so on. The writer are inclined to present the path of constructing China's administrative accountability system through the research of the concepts involved, legal basis, Western experience and the shortage of China's theory and practice in administrative accountability system under the multi-disciplinary approach and integration of cross-study.
