On Leagal Resolution Of The Business Conflict Between Policy Banks And Commercial Banks

Policy banks and commercial banks are two financial bodies which operate parallel with each other,and both are important parts of macro-economic control system of China.Operating harmoniously of both policy banks and commercial banks has an important significance to the development of the national economy.However,the business conflict rises between policy banks and commercial banks in recent years,which is becoming more and more severe.The business conflict between policy banks and commercial banks has not only hindered their stable development,but also is adverse to stability of the whole financial environment.Therefore,the solution of the business conflict between policy banks and commercial banks has a great practical significance.This body of the paper is composed of three parts:The first part makes a brief introduction of the meaning and relationship about policy banks and commercial banks with empirical method.On the basis of that,makes an analysis of the background of the business conflict between policy banks and commercial banks,namely,the process and significance of the policy bank and the commercial bank are separated into two independent individual.And again,it has summarized and analyzed the performance and the consequences of the business conflict between policy banks and commercial banks.The study of this part is intended for paving the way for the settlement of related issues below.The second part analyses the reason of the business conflict between policy banks and commercial banks concretely:the legal system and other related systems of policy banks are far from perfect.On the basis of that, this article makes an analysis of the business conflict between the policy banks and commercial banks from the perspective of basic theory of economic law,making a conclusion:the business conflicts between policy banks and commercial banks belongs to the study scope of economic law and resolving the problem with economic law is feasible and necessary.The third part is the one to solve problem.This part puts forward legal proposals for the resolution of the business conflict between policy banks and commercial banks:First,we can improve the legal system of policy banks in the view of internal operating mechanism.Second,we can set up specific legal mechanisms about the business conflict between policy banks and commercial banks in the view of external operating mechanism:mechanisms of business trust,mechanisms of business supervision,and mechanisms of conflict resolution.This article comprehensively adopts the positive analysis method,the case analysis method,the jurisprudence analysis method and other research methods.
