The Equality of men and women in most countries of the world is a perennial problem that can't to solve easily.Women occupy half of the population,No matter from the demand for democratic development or the social stability,their rights and interests should not be ignored and even deprived.Since reform and opening up in China,the Chinese women in politics,economy,education,culture,marriage,possessions,jobs aspects enjoy roughly equal rights with men,and their living conditions improved,development space expanded significantly,On the whole,their quality are increasing quickly.But under the restriction and influence of the primary stage of socialism productivity developing level and the social civilization degree,women development still faces many problems and challenges.Gender discrimination in jobs,there is a certain gap in women and men when it comes to resources possession and income;Women's participation in decision-making and management level is still low;There is a certain gap in men and women's education level;Women's health needs to be further satisfied;Women in the development of social environment remains to be further optimized;Women's social security level remains to be further improved.All levels of women are increasingly demand multi-facetted interests,women of urban and rural areas face unbalanced development problems have not been fully resolved.Therefore,It's important to protect women enjoy the equality of rights and interests,eliminate gender discrimination and realize the equality between men and women,they are the core aims of the women's liberation and development at the present stage in China,it's also an important task of building socialism with Chinese characteristics,and it's also the way to build a harmonious socialist society.The present study of protection the rights and interests of women is not much,most of the articles just analysis the rights and interests of women in a particular aspect,such as domestic violence,sexual harassment,land rights and interests loss of such specific issues analysis,but from the women's rights protection system for the analysis is not much,this paper is to straighten out,analysis,summarizes the domestic and foreign research materials about protection of the rights and interests of women,and to breakthrough the limitations of previous research exists or defects,combined with my own professional direction for further research.Firstly,This article defining the rights and interests of women and women's rights protection,and illustrates the contents and significance for protection of women's rights,this paper argues that "women" conforms to the trend of current social gender mainstreaming,protecting women's rights is to oppose other discrimination and discriminatory,so that women can exercise their legal democratic rights equally,and participate in economic and social development equally,even can share the achievement of reform and development equally.The content of the protection of the rights and interests of women,including political rights,culture and education rights,labor rights,property rights,personal rights,marriage and family rights and interests of six aspects.Protection of the rights and interests of women's social significance: it is a sign of social progress and development,for implementing the basic national policy of gender equality and realizing the premise of social harmony,it's an important content of international human rights law and the law in our country.Protection of the rights and interests of women's theoretical significance: it deepen Marx thought of the liberation of women,advancing the feminist theory research,promoting the social gender theory localization research,but also enrich the theory of harmonious society.Then,this paper elucidate the protection of the rights and interests of women's history and reality,including "before the may fourth patriotic movement"," the may fourth movement to the establishment of new China,"," the founding of new China to the reform and opening up," "since the reform and opening" four periods to comb the historical trace of the protection of the rights and interests of women,so as to sum up the experience of the protection of the rights and interests of women and analyze its existence.Based role to protect women's rights.But under the condition of market economy,the opportunities provided by the marketization to protect the rights and interests of women are not fully implemented,women lose the government's "umbrella",and under the influence of the potential of the implicit gender system and transition,women in the political rights,education rights,labor and social security rights,property rights,personal rights,marriage and family rights and interests are in a marginalized,unfair situation.The essence reason about the plight of women's rights protection is the marginalisation of women's status and the share of resources,and the existence of women's rights protection laws or regulations and policy have gender blind spots;The lack of women's rights including history,reality and women's own reasons.From the historical reasons,the traditional gender culture and traditional gender division of labor system serious influence on women's development;From the real reason,insufficient development of productive forces restrict the full realization of women's rights;Under the influence of the lag and lack of laws and regulations and the defective of the relevant mechanism,women can not get the "real" protection;Social environment has the serious gender discrimination that against women.Look from women's own reasons: female subject consciousness is not strong and women's overall quality is weak,so that women's rights protection situation is hard.For the above reasons,this article put forward to improve the thinking and countermeasures of protection of the rights and interests of women in contemporary China,first of all,we need innovative idea and methods of the protection of the rights and interests of women,including putting Marx thought of women's rights as the instruction,at the same time absorbing western feminist thought essence and the successful experience of other countries on women's rights protection;Second,we need improve women's rights protection policies,laws and regulations system,including perfecting our relevant laws of protection of women's rights content;To perfect our related department of women's rights protection functions: including strengthening government's responsibility and its functional departments,strengthening women's job responsibilities,continuously strengthening the role of civil organizations and strengthening inter-departmental cooperation,form linkage mechanism;Improving the working mechanisms of women's rights protection in China: including the social network of all China women's rights and interests,conscientiously strengthening the team construction of women's rights protection,the supervision to carry out the protection of the rights and interests of women.Again,creating a good social environment of women's rights protection,which requires us to promote the height of the development of productivity,material environment for women's rights protection;The mainstream of social gender consciousness into the decision,for the protection of the rights and interests of women,provide a good political environment;Constructing advanced gender culture,so as to provide good ambience for women's rights protection;boosting the equality of gender division of labor,provide good social environment for protection of the rights and interests of women.Finally,to improve their own quality and ability,including enhanced women subject consciousness,improve their own quality,and through the women's empowerment,promoting women's self-development ability.
