Homestead is the basic means of living and important property of farmers,and is also an important resource for rural development.Our country’s homestead system has the social security function and plays an important role in guaranteeing farmers’ survival and residence right and promoting rural society’s steady and healthy development.Under the background of rural revitalization,the problem of rural homestead and residential idle waste is increasingly prominent.The current homestead system has been difficult to adapt to the current rural social development.How to clarify the ownership of homestead,relax the restrictions on the circulation of homestead,and reform the current homestead system has become the focus of attention from all walks of life.The new round of rural homestead system reform takes the relationship between farmers and land as the main line,and explores the "separation of homestead ownership,qualification right and use right" as the core.The reform practice of solid right confirmation,steady promotion of right empowerment and orderly exploration of living right in pilot areas also makes the trend of homestead property rights clearer and value property more obvious.On this basis,combined with the field research of Fengyang County,Anhui Province,a pilot area for a new round of rural homestead system reform,this paper selects Xiaogang Village,Jinzhuang Village and Xiedian Village as the research objects.This paper probes into the reform practices of perfecting the collective homestead ownership exercise mechanism in Xiaogang Village,exploring the homestead qualification right guarantee mechanism in Jinzhuang Village,and exploring the homestead right circulation system in Xiedian village.It is found that Fengyang County pays attention to system construction,policy publicity,interest incentive,policy guarantee and management standard in the process of promoting the reform of "three rights separation" of homestead,and implements it through overall design and actions.However,in the process of the reform of "three rights separation" of rural homestead,Fengyang County also faces many difficulties.First,in the aspect of homestead ownership,farmers lack of awareness of property rights and unclear understanding of homestead ownership,and rural collective economic organizations are under great pressure to examine,approve and supervise homestead.Second,in terms of the homestead qualification right,the residence security function of the form of the realization of the homestead qualification right needs to be tested,and the subject of the protection of the homestead qualification right is limited.Third,the circulation of the right to use the homestead is too concentrated,the circulation demand is insufficient,and there is an obvious gap in the development funds of rural industry.Based on the above research results,this paper argues that to promote the reform of "three rights separation" of rural homestead should start from the following three aspects.Firstly,improve the homestead management system of rural collective economic organizations and villagers’ consultation mechanism,improve the homestead ownership exercise mechanism,and show the dominant position of the collective.The second is to explore the homestead qualification right guarantee mechanism,to fully respect the farmer’s homestead management will,explore a variety of ways to realize the homestead qualification right and safeguard the farmer’s rights and interests.The third is to explore the homestead use right circulation system,explore a variety of homestead use right circulation forms,strengthen the use of homestead circulation monitoring,improve the homestead income distribution mechanism to activate the property value of homestead.
