An Empirical Study On Civil Disputes Involving Villager Groups Of The People’s Court Of N County

Both village committees and village groups are forms of villager autonomy,but at different levels.The urbanization and need of infrastructure construction have led to an increase in expropriation for projects in rural areas.In addition,the villagers committee’s improper interference in affairs of villager group has brought ab out entanglements of economic interests,resulting in an increasing number of cases involving villager groups.The cases involving villager groups that have been heard by the People’s Court of N County in Hunan Province in the past five years fully demonstrated that there are three prominent controversies in such cases.First,the dual nature of villager groups.The villager group and the villager committee should have an equal and independent relationship with each other,but there is actually a situation in which the latter improperly interferes with the former’s affairs,causing disputes between the two.Second,the villager group’s eligibility to file a lawsuit is unclear.Some courts have determined that the villager group has the qualification to litigate and has the right to participate in litigation activities,while some courts have determined that the villager group has no qualification as a subject of litigation under the same circumstances,and thus dismissed the lawsuit.The totally different handl ing in standards for democratically agreed process review under the same type of cases undermines the uniformity and credibility of the law.Third,the responsibilities of villager group and villager committee are different.The ambiguous provisions on the rights and obligations between villager group and villager committee have resulted in disputes over the subject of responsibility,and the phenomenon of different judgments in similar cases has appeared in judicial practice.With the advancement of the rur al revitalization and village group merger plan,the number of personnel and property owned by a single villager group has also increased,which posed new challenges to the autonomy of villager group.And the role of villager group leader cannot be ignored.By constructing the independent civil subject status of villager group from related national legal bodies,improving villager group autonomy system,and clarifying rights and obligations between villager committee and villager group,the improvement of autonomy ability of villager group and reduce in disputes between village committee and village group are expected to be achieved.
