In the face of more and more automated or assisted decisions,the role of algorithms in economic activities has changed the traditional competition significantly,and the effect of algorithm collusion in market transactions has been proved to restrict competition.Whether it is the impact on the market economy,the impact of the original conspiracy theory or the challenge of the existing institutional framework,are all social problems that can not be ignored,and with the continuous improvement of algorithm technology,it will have a deeper involvement and influence on the field of competition.Domestic scholars are also paying more and more attention to this issue.There have been many cases in foreign countries,and some countries outside the region have also issued corresponding countermeasures.Although there is no case for analysis in China at present,it can be predicted that such cases will emerge in China in the near future.The development of science and technology and the continuous breakthrough of artificial intelligence bring great convenience to people’s life,but these inevitable negative effects are also penetrating into the public’s production and life.Law,as a means of regulating social order,should be forward-looking.Therefore,on the basis of in-depth analysis of the general theory of algorithmic collusion,this paper analyzes the special characteristics of algorithmic collusion compared with traditional collusion,and analyzes the state of collusion maintenance by combining the relevant knowledge of sociology and economics.On this basis,through the analysis of the competition effect formed by algorithm collusion,including the advantages and disadvantages in the competition process of market economy,and the impact on China’s anti-monopoly law system,combined with foreign institutions and practices,respectively proposed four principles of regulation algorithm collusion,including algorithm transparency principle;Interpretability principle;Principle of illegality/principle of reasonableness;Modesty principle,four internal system construction,including according to the category of collusion to do duality;Good-faith announcement to solve the problem of attempted coordination;Broaden the authority of anti-monopoly law enforcement agencies;Improve the accountability mechanism of algorithm collusion,and three external auxiliary mechanisms,including the implementation of hierarchical classification of data information;Construct the regulatory sandbox of algorithm collusion;Strengthen the self-regulation of industry organizations so that enterprises can effectively regulate algorithmic collusion through these studies.
