Research On The Responsibility Identification Of Tourism Operators’ Violation Of Security Obligations

Man has never stopped the pursuit of security.In recent years,tourism has been a large-scale,fast-growing and widely related comprehensive industry worldwide.It still plays an important role in national consumption in the post epidemic era.However,there are many risks and disputes in tourism activities due to the mobility of tourists,the non-local nature of tourism sites and the risk of tourism projects.Therefore,the security obligation of tourism operators has long been one of the important issues in the field of tourism law.This article mainly contains the following five parts: the first part analyzes the basic theory of the safety and security obligations of tourism operators,including the basic theory,comparison with other types of liability,the content of the legislation and the selected case samples for explanation,laying the foundation for the subsequent contents of the article;the second part analyzes whether the definition of the safety and security obligations and liability of the elderly in tourism is clear;the third part analyzes whether the apportionment of liability between tour operators and travel support services is consistent with the doctrine of majority tort;the fourth part analyses the above-mentioned judicial status and puts forward suggestions for improving the tourism liability system,standardizing specific standards in the tourism industry and determining the effect of the judicial application of the norms,based on the actual situation in China.This article mainly takes the perspective of realistic tourism disputes,takes the concept of safety and security obligations and the content of legislation as the theoretical basis,collates and analyses 108 cases of breach of safety and security obligations by tourism operators,explores the two judicial practice issues collated,and puts forward relevant recommendations on the determination of liability,with a view to better analyzing the limits of safety and security obligations of tourism operators,and putting forward recommendations to improve the travel liability system and The aim is to better analyze the limits of the safety and security obligations of tourism operators,and to propose suggestions for improving the travel liability system and insurance system,so that tourists can better protect their own rights and interests,and promote a more appropriate resolution of tourism disputes,as well as a healthier and more orderly development of tourism.
