Research On The Supervision Mechanism Of The Work Of The Supervision Commission In The New Era

In order to strengthen the supervision of all public officials exercising public power,form a joint force of anti-corruption work,and promote the complementation of inner-party supervision and state supervision,China carried out the reform of supervision system.On March 20,2018,the first session of the 13 th National People’s Congress voted to adopt the supervision law of the People’s Republic of China(hereinafter referred to as the supervision law)and set up a supervisory organ,which made it clear that the supervisory committees at all levels are the specialized organs that exercise the state’s supervisory functions.They supervise all public officials(hereinafter referred to as public officials)who exercise public power according to law,investigate job-related violations and job-related crimes,carry out clean government construction and anti-corruption work,and maintain the dignity of the Constitution and the law.The reform of national supervision system is an important part of China’s political system reform,which is of great significance to the modernization of national governance system and governance capacity.At the same time,it is also an initiative to build an anti-corruption system with Chinese characteristics and perfect the supervision system of the party and the state.After the reform,the supervisory organs hold the power,expand the scope of supervision and enrich the authority.No matter based on the system consideration,mechanism specification or practice analysis,it is indispensable to supervise and restrict the supervisory organs.General Secretary Xi Jinping stressed repeatedly that trust can not replace supervision.Strengthening the power restriction and supervision over the supervisory organs can not only effectively prevent corruption and abuse of power,but also be an important guarantee to prevent the supervisor from "dark under the light".At the same time,it plays an important role in promoting the correct and standardizedexercise of supervisory power by supervisory organs and makes them more authoritative;it is conducive to strengthen the self-construction and management of supervisory organs and promote the construction of discipline inspection and supervision cadres that the party can rest assured and the people can trust.At present,our country is still in the period of corruption,the task is still heavy,many new problems bring new challenges to the work of discipline inspection and supervision organs,but also bring new difficulties to the supervision and restriction mechanism of supervision organs.For example,in the supervision of the Party committee at the same level,it is faced with the connection and coordination problems of power confusion,suspicion of self-supervision and Party discipline and state law caused by the joint office of the Commission for Discipline Inspection and the supervisory organ;in the supervision of the people’s Congress,there is a problem that the staff of the people’s Congress are supervised by the supervisory organ;in the restriction of the judicial organ and the law enforcement department,it is faced with the obstacles of power imbalance and the lack of independence of the supervisory organ;in terms of internal self-supervision,there are problems in the disposal of crimes committed by internal personnel by supervisory organs themselves;in terms of democratic supervision,social supervision and public opinion supervision,there are problems such as insufficient publicity of supervision information and difficulty in giving full play to the actual effect of such supervisionTherefore,the key to the formation of effective supervision and restriction on the supervisory organs lies in breaking through the existing difficulties in the current mechanism.Based on the working experience of the supervisory committee and the study of the spirit of the 19 th National Congress and the Fourth Plenary Session of the 19 th Central Committee of the Communist Party of China,analyzes the shortcomings of the current supervision andrestriction mechanism of the supervisory committee,and discusses how to improve the supervision mechanism of the supervision committee,enhance the integrity of the supervision committee,play its practical role in supervision,and effectively guarantee the realization of social fairness and justice and the rights of the people from the aspects of properly solving the connection problem of joint office and Party discipline and state law,strengthening the horizontal restriction of judicial organs and law enforcement departments on supervisory organs,improving the self-supervision mechanism of supervisory organs and so on.
