Research On The Legal System Of Emergency Material Price Supervision

Public health emergencies are the most serious and harmful emergencies in the world,which affect social stability and the safety of people’s lives and property.After the outbreak of public health emergencies,how to strengthen the price supervision of emergency supplies is a hot issue during the current emergencies.After the outbreak of new coronavirus in 2020,whether emergency supplies can be guaranteed is an important factor to maintain social order and stability and protect people’s lives.The current laws and regulations of our country have no special provisions on the price supervision of emergency materials,so improving the legal system of the price supervision of emergency materials has become the primary task.Analyzing the relevant concepts of emergency materials and price supervision is the basis of studying the theory of emergency materials price supervision.After having a full understanding of the relevant concepts of emergency materials,this paper points out the current situation and existing problems of China’s legal system of emergency materials price supervision.The main problems are as follows: at present,the effectiveness level of normative documents on emergency materials price supervision is low,The authority and stability of the legal system are seriously insufficient,and the binding effect on the price law enforcement departments is not strong,so it is difficult to fully meet the needs of emergency material price supervision;The price intervention mechanism of emergency materials is not perfect,which makes the government and its price departments unable to make timely emergency disposal in the price management of emergency materials,seriously affecting the efficiency of emergency management;The standard of illegal identification is not clear,and the specific standards of illegal identification are quite different in different places,which leads to the different results of the price authorities in dealing with the same or similar acts of driving up prices;The imperfection of the accountability system leads to the administrative law enforcement agencies have greater administrative discretion in the application of the law,which is not in line with the predictability of the law;The regulatory responsibility of regulatory agencies is unclear,the coordination of regulatory agencies is insufficient,and there are overlapping supervision,repeated law enforcement and waste of resources in regulatory work.These problems have brought difficulties for the government to supervise the price of emergency supplies.In view of this,it is necessary to improve the legal system of emergency material price supervision.First,improve the price supervision system of emergency materials,speed up the special legislation of the price supervision of emergency materials,improve the current price legal system of our country,and provide legal basis for the price supervision of emergency materials;Second,improve the price intervention mechanism of emergency materials,improve the rationality of the government’s price setting,through the implementation of price intervention measures,play its role as a link in the price adjustment,so as to make the allocation of emergency material resources more reasonable;Thirdly,we should make clear the standards for identifying the illegal price of emergency materials,provide law enforcement standards for price authorities,reduce the impact of price crisis on social economy,and strive to maximize public interests and minimize enterprise losses;Fourth,we should improve the accountability system for illegal price of emergency materials,enhance the practical operability of the legal system for price supervision of emergency materials,and ensure the smooth progress of price supervision in special periods;Fifth,we should implement the responsibilities of price supervision and law enforcement agencies,strengthen the supervision and guidance of local governments at all levels on the supervision departments,promote exchanges and cooperation among various departments,improve the overall efficiency of emergency material price supervision,and ensure the effective implementation of supervision.
